Normally I agree with JohnnyPC and am the first one to make fun of the whiners and tell them to get a life. This is not that situation. I have the gift of common sense and can recognize the difference between an honest mistake, and shady behavior. This is definitely shady. They had the laptops on clearance all day for an excellent price. The stock was depleted and replenished throughout the day. Then suddenly the price increases and more are available. Then because they KNOW they did something wrong they remove the item completely. Then they send contadicting email to several different customers with different explanations of why they can not get a laptop. Plus they admitted in an email and a phone call to customers who posted here that they got a special price on these laptops and thats why they are so cheap. They went on to say a different wholesaler supplied them with the "more expensive" laptops. Then they go back and say they never had ANY of these laptops. The very first person to order (the creator of this thread) is not even getting his laptops. They are LYING plain and simple. Boycott Lie.com..

No. It is not bait and switch. We ordered when the item was in stock. We even received confirmation for it. In a bait and switch case, you would not be able to order, wouldn't you?

I am still wondering two things; 1. Did anybody actually receive the Sony Vaio PCG-FX190 (850mhz) from Buy.com and 2. Has anybody heard from the attorney as yet (I sent and email last Friday)? Thanks

I just submitted this to their customer service dept. Don't really care if they respond or not, unless it says my laptop is on it's way.

This email is to voice my dissatisfaction with buy.com.

This is regarding the "issues" with the Sony VAIO computers that were listed in your clearance section last week.

I was one of the many customer that were lucky enough to order one of these computers when they were listed as "in stock". Then only to find the order cancelled the next day. To this day I have not received any explanation as to the reason for the cancellation. At this point, I don't care what the reason was.

The way the situation was handled was both unprofessional, and unacceptable. And i'm not even talking about the many different stories that fellow buyers have received when inquiring about their own orders.

I'd always though buy.com to be one of the top online retailers, and recommended buy.com to friends and relatives. This I will no longer do. While your prices, at times, can be competitive, this is no longer a factor due to price-matching, and price protection offered by credit card companies. It then comes down to one thing. Service. And while buy.com has not yest sunk to the level of Best Buy, the level of service is dropping.

At this point, I will encourage buy.com to keep their prices competitive. As it will allow me to continue to purchase goods from more reliable retailers, be they online or brick-and-mortar. And use the various price-protection policies to get the lowest price.

Sincerely,
Codey Fujita
Former Buy.com customer

Perhaps the lawyer knows that bye.com has no more money even for a small lawsuit.

I am SOOOOO @@#@#$R@#!!!!!! My shipment was due to arrive yesterday - no one was home - when we got home, there was no UPS little sticker on the door and no package!! So, I tracked it online - it said it was refused from here and therefore being sent back to buy.com!!!! So, this morning at 7am, we went to the local UPS office and spoke to the manager, who said they got a call from some lady who works for Ingra Micro (????) telling them to return the product prior to first delivery. Now, I have already been charged for this on my bank account, and the funds have been released! Can they do this? Is this legal? According to the rep at the 800#, they shipped out the wrong computer. Well, I had an order in for one of each of the two laptops, which got cancelled, and for the slimtop, so any vaio would be ok with me. Of course, no manager is available to speak with at the 800#, so now I just don't know what to do! I haven't gotten an e-mail cancellation for either of the two laptops, and no phone call or anything about this order being messed up! I WANT MY PRODUCT!!! GRRRRR

The story continues....I finally spoke with a manager at buy.com 800#, who is going to see what he can find out for me, but who also stated that it was Ingra Micro who stopped the shipment, so they were responsible - spoke with Ingra Micro lady that was the contact person on the official UPS sheet to stop the shipment, and she has gotten 100's of calls about this same thing - she does not even work in their shipping dept and has no clue what is going on - she referred me to her manager, who stated that Ingra Micro is not involved at all in the recalling of these packages, that this is a buy.com issue, and that they would leave it up to the customer to return a package if the customer was not satisfied. Also, he stated that they are a shipper for buy.com (a supplier) and do not deal directly with any of these issues - they ship out as buy.com and other companies instruct them to, and they get paid from these companies, not the customer directly. So, buy.com is definitely doing something very fishy around here...

i felt like sharing this little rant from a discussion i had with a friend about this kind of stuff...

this is 2002 not 1996
we have inventory mgmt systems, content mgmt systems, complex pricing/sourcing algorithms
they all contribute to deciding what the price and availability of a given product is on a site

and then "mispricings" occur... but you have all those systems, misprices cannot occur!!
someone somewhere in your company set that price!
i am just Joe Consumer trying to buy your products at the advertised price!

perhaps they need some more systems to let them know when a run on a product is occur, or when hits on a certain product page exceed a limit, so they know something is up with that price/product

but that is not my problem... i am Joe Consumer and this is the web that you have talked about for years.
i am fulfilling the promise of the web by buying from your site, you keep saying you want me to come to your site and buy sh1t...

well here i am!!!

Well, Buy.com called back and I am expecting a call from corporate later today - seems there are "six"of us whose orders were shipped out after the supposed "pricing error" (that's what the manager said it was - a pricing error on their website! So, guess they didn't run out of stock???) whose orders were stopped by buy.com prior to delivery, and whose credit cards had already been charged. So, corporate is re-sending our merchandise, at "no cost" to us. Like I would pay shipping again to have this re-delivered or something! I know for a fact that many people already had these items delivered, so their telling me that there are only 6 of us is crap! I hope I see the computer I paid for soon!

Who did you talk to at Buy.com (and at what phone #) and how did you "corporate" to call you back? This is getting more interesting all of the time. Thanks.

I got manager Tim at CS 877# to figure out why my shipment was recalled by Buy.com prior to first delivery. It actually reached my city, and then the manager at UPS had orders from the supplier to send it back without trying to deliver. So, after dealing with CS Manager and one of the managers at Ingram Micro (supplier), they are going to re-ship it to me at no charge - corporate is supposed to call me back to arrange this or let me know what else is going on - supposedly, they are compiling a list of people whose computers shipped and were subsequently recalled, and whose credit cards were already charged. Thing is, I think I was getting a laptop from the weight and dimensions of this package, and that's what I really wanted anyways. I don't want the package to get back to CA so they can switch my merchandise for some refurbished or defective model in the back! I've heard of that happening before! Do I have any recourse to request that the same package be shipped to me regardless of what's in it? I had an order in for each of the two laptops (which got cancelled) and the slimtop (which is the one being shipped), so no matter what I was going to get, I would have been happy. I was told my two orders were cancelled because they ran out of stock, but now it seems according to the manager that this was a price error, even on the slimtops. That is why everything got cancelled. Wonder what they are going to do with al of the Vaio's that they cancelled orders on? Not like they can put them back on their site at all without facing a lawsuit, since it was a clearance item and orders were cancelled due to lack of stock (or so we thought). I'll let you know what happens next!

California AG's department of consumer affairs dept. complaint form is on-line
for those interested in building a body of information on all of this. The AG's office
doesn't automatically pursue remedies unless there is a pattern of deceptive practices.
Given the variety of buy.com actions/stories that have been reported here, I think the AG's office deserves a look. We can collectively debate the merits of various remedies, but the AG is the one with the definitive call on this one.

BTW - isn't it an election year? ;)

Woo...hoo , $65.

Thank you for your recent order(s) for the Sony Vaio PCGFX190 PIII 850MHZ
128MB 30GB DVD. We've experienced unforeseen complications with the
availability of this item. As a result, your order(s) for this product has
been automatically cancelled and your credit card will not be charged.
Please be assured that we strive for complete accuracy in availability
listings on our website. Nevertheless, because of the number of products
offered by buy.com (nearly 1,000,000) situations such as this at times
occur.

We apologize for any inconvenience this may have caused you. We would like
to offer you a $65 buy.com gift certificate to thank you for your
understanding. Please expect to receive your gift certificate via email
within the next 24 to 48 hours.
