Gotta speeding ticket clocked at 102Mph =(

I was on the 5 south Freeway w/ a friend on our way to UC San Diego to visit some friends this weekend. I was going 100 at times but when i got caught i didnt bother checking my speedometor. Well the cop was an asshole. He said that i was approximately doing 102, then my friend asked how do you approximate 102? and he said that his gun isnt calibrated or some bullshit.

My friend mentioned that speeding tickets over 100Mph can get you license taken away. Does anyone know how much tickets are?:( Do i have any chance in fighting this ticket off?

Well, about 5 years ago I got a speeding ticket for, I believe for 15 over, and it as around $145.

dude - ifit wasn't calibated, then you have a case, just make sure you request in court that the records be shown that the gun was calibrated, make sure you mention thatthe cop said it wasn't, adn request any other info. Also, request the cop be there on that court date. And if they don't send you info before court date that ANOTHER reason to dismiss the ticket. Make sure you don't say you are guilty of 102mph

Actually, you were lucky. The cop could have hauled you off to jail and impounded your car for reckless driving.

As to the radar gun "not being calibrated", he probably didn't get you on radar but will swear in court that you were doing well over 100 MPH which he is well trained to approximate.

At any rate, expect this ticket to be very very expensive (including an insurance rate hike).

In California, the cops never miss a court date. Of course you have a chance at fighting this ticket in court. Look how far Gore got . . .

Your lucky. Here in NJ you get caught doing over 100mph you instantly go to jail. When you are driving that fast a host of other charges in additon to speeding are invoked. I think you lose your license for 6 months no questions asked. You should get a lawyer and see if you can get them drop it to lower than 100mph. If the judge is in a bad mood he might even give you a few days in jail. This may sound wrong, but if I pass a cop who is sitting still and I am going over 100mph, he going to have to catch me because it is a very serious charge. And yea I did do just that. Luckily in ended with no one getting hurt and with me not getting caught.

Over 100Mph... you were showing off and got caught. Sorry, no pity from this penguin.

Pay the fine and be thankful cop didn't impound it and drag your butt off to jail for reckless endangerment.

Wow thanks guys.. I know you guys are just layin the facts down about the consequences i am about to face. So i guess the worst case scenerio is that i goto jail? according to someones reply.

Would i see an insurance hike even if i decide on going to traffic school?




Dameon: How was I showing off? When writing this thread i had no intentions on showing off; however i was only hoping to get some helpful information from people. Well sorry if you thought so.

Let's see, you were either going 32 or 37 miles over the speed limit.

You are going to have some serious explaining to do to a rather unsympathetic judge. A lot is going to depend on the testimony of the officer; the conditions of the road - how much traffic there was; were they all going 90 mph?; were you passing in an out of traffic? etc.).

Was the officer a radar cop? was he pacing you or estimating your speed (maybe you were only going 97 mph).

Certainly you should look up the California statutes to see the worst that can happen. And if it is very bad, you might consult a lawyer. If your record is spotless up till now, the law might allow for traffic school (to keep it off your insurance) but you will have to pay a hefty fine.

I doubt if jail will be an option or you would have already been. Just expensive.

Slow down.

you deserve to get your ass busted and your liscense taken away. What happens if you blow a tire at 102 and go spinning out of control and crash into another car? Stupid punk. And it doesn't matter if the cop's gun was calibrated or not. They DO NOT need a radar detecter to get someone for speeding. If the cop wanted to, he could just eyeball it and bust your ass.

Seriously, if someone does 100+ mph in public and violates the law I say throw the book at 'em. If you want to "express yourself" or get a "thrill from life", drive out to Death Valley and let her rip. That way you only endanger lizards and yourself, not me and others.

Going over 100 mph. Ouch! (Try to get it lowered to 99 mph). From the Cali Vehicle Code:

Excessive Speed and Designated Lane Use

22348. (a) Notwithstanding subdivision (b) of Section 22351, no
person shall drive a vehicle upon a highway with a speed limit established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.

(b) Any person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable, as follows:

(1) Upon a first conviction of a violation of this subdivision, by a fine of not to exceed five hundred dollars ($500). The court may also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5.

(2) Upon a conviction under this subdivision of an offense which occurred within three years of a prior offense resulting in a conviction of an offense under this subdivision, by a fine of not to exceed five hundred dollars ($500). The person's privilege to operate a motor vehicle shall be suspended by the Department of Motor Vehicles pursuant to subdivision (a) of Section 13355.


So the question is, have you had any other speeding tickets in the last 3 years? At any rate, you may be fined $500 and have your license suspended for up to a month.

EDIT: JellyBelly, what a personal question. Ahem, I don't remember. I will state, I haven't have a ticket in well over ten years. I will also state I do know the value of knowing what is facing you and that research really pays off.

I suspect that traffic school may not help with this, as the DA may want to make an example out of you and charge you with reckless driving. Frankly I think you have some nerve calling the policeman an "asshole". He could very well have taken you to jail, among other unpleasant things.

Tee_Edwards, wouldn't the Police Officer already have written "reckless driving" on the ticket in addition to "speeding"?

EDIT: BTW, there are also cops in Death Valley. :)
