Got screwed out of a $350 (sucky camera on ebay)

Okay, so I bought a supposedly nice refurbished digital camera off ebay.

Worked great for one day, then conked out on me.

The seller won't reply to my e-mails (he has over 1000 positive feedbacks, so I guess he's pretty reputable) and I called Sony and they told me since I bought it off eBay, I have to take it over to a store of theirs and pay however much it costs to fix it (I'm guessing between $50 and 100?).

It's so much of a headache. Is there anything I can do or say legally against the seller? I'd be happy if I just got my money back.

The terms of shipping in fine print are:

"Terms: All sales are final. Winning bidder assumes all risk of liability with respect to the purchase of the product, buyer responsible for shipping charges. Payment expected within 4 days of auction close."

Does this mean I'm screwed?

Did the listing specify any type of warranty? If so, and the seller refuses to honor it, contact eBay. If the listing said "as-is", you're SOL.

Thanks for the link. Warrant info from the auction description:

"Warranty: This product is covered under the full manufacturer warranty. If product is received DOA (dead on arrival), a replacement will be sent immediatley."

I called Sony, and they said the "full manufacturer warranty" isn't valid since I bought it off eBay. They made me feel like a fool for buying a camera off eBay, too. The stupid woman pretty much laughed in my face (on my ear, whatever). :(

Luckster is correct. DOA is generally defined, at a minimum, as seven days, and up to 30 days.

seems to me that if he states that it's covered by a full manufacturor warranty but the manufacturor denies this that you should be able to return it to him, personally, I'd expect him to refund my shipping as well

I contacted the seller three times without him replying. Once when I found out it didn't work, again the next day, again a couple days afterwards. Yeah, I'll wait until tomorrow before I call him and I'll try to stay calm. That'd better be his correct contact info! I'll be pissed if it isn't. Oh yeah. Calm. Stay calm. Got it. :cool:

I'll let you guys know how it goes. Sony basically said a no go on that warranty, so I hope I get my money and shipping ($15!) back.

you might want to go over the instructions thoroughly and be sure it is DOA too.. it could just be a defective or under charged battery. Is this a Mavica?
