In all seriousness when one has "untested" and or "as-is" I'd stay away from it. It looks like he may be in the safe. He does not neccessarily say that it comes with the cd-key and game. It just says COD game. You'd assume it did come with the cd-key though.

There is something in this world called "Common Sense". You buy a car, it comes with the car key. You buy a game, it comes with the CD key. You don't fvcking assume.

You might be at a loss because of your decision to bid on his auction that states "As-Is". I hate to encourage this type of behavior but if you really want to play it, it might be best to play it with a pirated cd-key.

The only reason I am buying the game is to play online. You can't do it with a pirated cd-key.

the guy doesn't have the greatest feedback, but he certainly looks like a business so it might be legit that they wouldn't respond to emails right away?
with the number of auctions that guy has i'm sure it takes him (them) a day or two to even see your email. you might look up his info and give him a call tomorrow

So? That doesn't mean he didn't get ripped off. Not saying he has a valid way to get his money back, but it certainly shady to have that type of business. Buyer beware.

Ok... do you see the number inscribed onto the CD? (in the middle), that's kinda like a serial number. Call up Activision tech support or customer service and tell them you lost the fcuking CD case, and ask them to give you the CD key. They will ask you for those numbers on the CD, damn... easy fix, nothing to fuss about.

Ummm... when Call of Duty first came out, a LOT of copies shipped without cd-keys. Contact Activision and they should rectify the problem. I'm going to assume you got actual game disks, and not some burned copy. You will have to verify somehow that you bought the copy, but that shouldn't be too difficult.

IIRC, selling software (even used) without a CD key is piracy, as the CD key is the de facto software license. Maybe someone should call Activision or the BSA?

Well I can see two options.

1) He said it is sold AS IS and no where does it say it comes with the CD KEY so you could be SoL.

HOWEVER

2) He says "The packaging has been open for product inspection"

This implies that the packaging was SEALED and he had to OPEN it to inspect the product. Now if it was sealed, then there would be a CD KEY in the box. If all he did was INSPECT IT, then there would STILL be a CD KEY in the box. So, he's obviously lying and didn't open it to inspect it, he had it laying around, with no key, and decided to scam someone on ebay with it.

Did you pay Paypal through a Credit Card or bank? If Paypal won't help, go to your CC company and dispute the charges. Not sure if that would work because technically you gave paypal permission to do that but who knows...

Anyway, good luck.

P.S. I'm sure you could find a different CD KEY online somewhere if you needed one.

Go to Walmart. Open up a Call of Duty box. Record the CD-Key. Put the CD back in the box, put the game back on the shelf, walk away casually.

By the way, I also got a Call of Duty retail, sealed box from gogamer.com without a cd-key. When I e-mailed them about it, it sounded like it wasn't an uncommon problem. They just had me send in the back paper from the cd case. They then e-mailed me a key and send out a new back paper with cd key through the mail.

Obviously you can't do that...

Oh, to the person right above me, not only is that an incredibly stupid thing to do, the CD key is printed inside the jewel case, which is, IIRC shrinkwraped. Good luck trying to get at that without anyone noticing.

Lastly, we don't test something, see it doesn't work, and then list it as "untested as-is". If it doesn't work, we'll tell you that. If we say it's as-is and untested, its exactly that. You're taking a risk and sometimes you get a great deal, othertimes you do not.

You don't need to test it to know if a cdkey is included or not.

Can't he just call tech-support for the game and explain what happened and see if they would provide him with a key. (he could fax over the ebay invoice if they wanted proof. Just a shot in the dark, but all it would take is one simple phone call to find out).

I think this is a bunch of bull what is going on in this auction. It's basically a coaster or an extra AOL cd to lay around the house without the code. Not fair at all....but the wording definitely fits with the description. He did sell 'as is' although missing a cd-code is something I would never have thought someone would try to pull off...

Open the CD case, pull the flap forward (there are two CDs you realize?) and its hidden behind the second CD printed right into the jewel case.
