Got rear-ended yesterday by a girl who doesn't have insurance

Screw her. She's doing something ILLEGALL, it's her own damn fault if she faces the penalties of it.

If I have to pay for insurance even though I've never been in a wreck, you bet your ass she should. Chances are, she's been in enough of them that she can't afford her insurance. Get her off the damn road.

In Texas, you must call the police immediately and then remain at the accident site until they arrive, if you leave and try to do it later, you get no police report. That means you cant claim it on your insurance.

Always have an accident documented! Call 911 and have them come out and file an accident report. This way if the party at fault wants to give you compensation for the accident (outside of inusrance), then backs out, you have a detailed, documented report to turn in. I've been through this before.

Case 1) You get the car repaired by your insurance.

Case 2) You may or may not get money, so you may or may not be able to repair your car, are possibly breaking the law, and are going against your contract with your insurance company.

Why again are you interested in case 2?

Huh?

There's no legal requirement in my state to report accidents to insurance companies, at least none that I'm aware of.

The only possible benefit in this case is not increasing your insurance premiums by not making a claim. However, the risk reward ratio just doesn't make sense!

You're probably legally obligated to report it to the state, in which case your insurance company would find out eventually anyway.

There is no upside (for you) to not reporting it, you have everything to lose & nothing to gain.

Dude, if she doesn't have insurance, she probably can afford insurance. And if she cannot afford insurance, how the hell is she going to pay you for the damage she has done to your car? Liability is not that expensive, especially for females, even though IMO more accidents involve female drivers than do male.

Make sure you have everything in writing. Otherwise, she can claim she didn't do a thing, and you would be screwed because you didn't claim it.

Took the words right out of my mouth. Take no chances. Do you have comprehensive coverage just for situations like these?

It is probably too late at this point to file a police report. Too easy for her to say she didn't do it since it will be her word against yours.

I say have her pay with sex and after you hit it then report her to police and insurance.:D

at least in CA, if there is damage over $500 or $1000 or whatever it is these days, you must by law file a report with the DMV. and seriously, regardless of what route you take, she still has to pay for your car, so you might as well let the insurance company do what you pay them for and take care of it for you.

I've been a bit bogged down with work, so sorry for the late repsonse. Let me address a few of the questions:


- She's cute.

- No pictures, sorry.

- Damage is minimal...some scratches and indentation.

- Zim Hosein: Why would my premium increase if she hit me?

- RossMAN: I got her contact info...her drivers license number and license plate number.

- The "reason" she doesn't have insurance is because she claims she just bought the car off an auction and didn't have time to process any.

- No pics of the girl's rear-end.

- The reason i'm conempmlating this is because i wouldn't mind keeping the cash. My car is old and is on its last year or so.



Thanks for all your suggestions. I haven't had much experience dealing with insurance and accidents and such. I'm going to go ahead an report the accident to my insurance company and ask them to hold off on going after her until i confirm whether or not she ponyed up some cash.

It's a lot easier to just go through the insurance company. I was in much the same situation as you, and it's just a hassle to deal with people sometimes.
