got "paced" by a police officer. ideas:

As long as she does not lose sight of you she does not even need to match your speed to pace you....if she's going 15 and you're gaining ground, she's not speeding and can confirm that you are. The "it's illegal for her to speed with no lights on" is never going to fly either way, so it doesnt' really matter when she turned her lights on.
 
That is not true! Police break the speed limit all the time with no lights or sirens!!l

Just because it happens doesn't mean it's legal. Two and Two and all that...

I don't know the law there but something happening doesn't by definition make it legal or illegal.

IMO, pay the ticket.

i got stopped once by res cops here while on my motorcycle. they tend to not like motorcycles apparently. on the ticket they wrote that i was doing 90 in a 45. they also stated they paced me, and had to reach speeds of over 110mph to catch up to me. all this was bullshit, i was doing 50 the hole time and they stopped me 1/2 mile from where they saw me. they also had to flip a bitch since they turned left in front of me while i was making a left turn. i even had witnesses in court, but the judge wouldnt listen to logic at all and told me i was wrong. BUT he couldnt prove my speed since they didnt have enough time behind me to "pace" at 90. i retorted that they wouldnt have gotten close to me in a half mile if i really were doing 90. that didnt help at all, and i ended up spending 2 days in jail. really sucked. i swear the judge was a friend of the res cops tho, because even the mesa cop that showed as back up said it was impossible with the given data. he was also the only thing that kept me from a reservation jail trip.
 
Read the post. That's not my defence, merely my justification for speeding. Take it how you will, I am not asking for your opinion of me, or my driving tactics. Thanks

Goes great with the "I am not really sure" part.

Let that judge know you are free to drive however fast you fucking feel further down the beach in the 15mph zone since it's a freeway in reality.

Bring a video cam to court if you go, we have to see this.
 
LOL OP is so screwed and he knows it. I'm disappointed she didn't try to get the OP for reckless driving, which he surely was doing. If I was her I would have given him a ticket for reckless driving also.

Lesson: Don't go 35+ in a 15mph zone. You might kill somebody, especially at the beach.
 
You were completely and totally in the wrong. Whatever she did to pace you, you were still going at least 10 mph over the speed limit by your own admission. Pay the ticket.

It would cut down on tickets tremendously if everyone started to fight their tickets. This would force the cop to come to court and spend days testifying in court. If you want to question the officer prior to court, you can take his deposition and also make sure to subpoena duces tecum the calibration certificate from his speedometer. How do you know his speedometer was accurate? Anyway, there are lots of angles to look at. I suggest you fight it and do NOT hire an attorney. The attorney doesn't care if you win or lose, they still get paid.

I got paced... but got off.

I was doing 37 or so (I swear the needle was between 35 and 40).... they said I was going close to 40. Speed limit 30, but it's a 2 lane each way, wide road with a median too... close to 11pm at night. Most people speed it up there. I think they were looking for DUIs mainly so they let me go.

you were speeding quite a bit. I'd say it's hard to get off that. 5 over? 10 over? Maybe you might barely get away. 20 over? good luck!

You know that's part of the job right? Like going to court and stuff each week and testifying. There is usually a day set aside for just that.

Thats why you start with a trial by declaration.

Word on the street is that they get OT for court, and normal pay for writting a declaration. either way, i am planning on being a thorn in her side.

Any ways, I am thinking I will argue it(off principal more than anything else..this lady was looking for a fight.) and I have a few questions

My defence will be 2-fold, 1 a simple calculation shows that she'd have to had accelerate at ~10m/s^s to pace me for a solid 1/4th mile as she laid down on the ticket. This is dependent on where she started pacing me, obviously, but I believe it was at the main entrance to the beach, in which case this argument would be true. My issue with this is that I am not 100% certain she wasn't already on the beach pacing me a ways back.

I was in my buddies Jeep, and I hadn't correctly adjusted the rear view mirror so I didn't see her right away[ I was just going ~1 mile to pick him up further down the beach]

Next, police officers are to have their lights, siren or both on when breaking the speed limit(in California at least), which I do not believe she did.

So my questions are:
1) How can I get a statement on where she started pacing me? I didn't have any witnesses, nor did I notice myself.

2) How can I get her to comment on when she turned on her lights? Again, if she realizes why I'm asking I am not sure how truthful she'd be.

I think she chose 35 out of thin air, mostly because the fine goes up when you're 20 over.

Luckily she didn't cite me for reckless driving... Not sure if she could since she wasn't a "real" police officer any ways.

I like how most of your defense rests on your guilt. The math will surely win over the judge.

You have a good heartedly perverse misunderstanding of the legal definition of guilt. Never ever ever ever ever plead guilty in a court of law.
 
its totally up to the judge and his mood.

Doesnt matter if your correct or not.

IF you piss off the judge you will end up paying.

If the judge is pissed off at the cop, you will get away.

The judge is the person u want to kiss ass to.


My recomendation is to fight the ticket, plead not guilty.
If the cop shows, your screwed... the judge will always take the cops side.
If the cop doesnt show, then your case gets dismissed.

On a small violation like this, and also the cops mood, he may not show up.

Im @ about a 3/5 ratio... meaning out of 5 times i pleaded not guilty the cop hasn't showed up 3 times.

I've had a similar experience with a corrupt overweight Sheriff in some nowhere, in-and-out, Duke of Hazzard bumblefvck town in Oregon.

Just plead "guilty" and pay the ticket. The guilty charge will get your fee reduced by a sizeable amount.

See if you can go to Traffic School so it won't hit your DMV record.

If you go to court, the smarmy ASSHOLE judge can take your situation from bad to worse and you WON'T get ANYWHERE with him/her! You'll just leave pissed that you wasted your day and pay/vacation.

What I'm saying is don't bother going to court when you know you are guilty. Did he or did he not, even in his own estimation, exceed the speed limit by an amount that virtually any officer would issue a citation for? The answer is yes. Only a dick would attempt to get off on a technicality in this case.
