got paced on a beach here by the beach enforcers.

Said i was going 35 in a 15.

I don't belive that's accurate, but I was going a bit quick, maybe 25-30.

Any ways, I am thinking I will argue it(off principal more than anything else..this lady was looking for a fight.) and I have a few questions

My defence will be 2-fold, 1 a simple calculation shows that she'd have to had accelerate at ~10m/s^s to pace me for a solid 1/4th mile as she laid down on the ticket. This is dependent on where she started pacing me, obviously, but I believe it was at the main entrance to the beach, in which case this argument would be true. My issue with this is that I am not 100% certain she wasn't already on the beach pacing me a ways back.

I was in my buddies Jeep, and I hadn't correctly adjusted the rear view mirror so I didn't see her right away[ I was just going ~1 mile to pick him up further down the beach]

Next, police officers are to have their lights, siren or both on when breaking the speed limit(in California at least), which I do not believe she did.

So my questions are:
1) How can I get a statement on where she started pacing me? I didn't have any witnesses, nor did I notice myself.

2) How can I get her to comment on when she turned on her lights? Again, if she realizes why I'm asking I am not sure how truthful she'd be.

I think she chose 35 out of thin air, mostly because the fine goes up when you're 20 over.

Luckily she didn't cite me for reckless driving... Not sure if she could since she wasn't a "real" police officer any ways.

LOL....she was breaking the speed limit in order to pace you. That is not going to fly in court.

That is not true! Police break the speed limit all the time with no lights or sirens!!

You will lose your argument in court.

Just pay the ticket!! There is no principle to stand up for.

She was a beach enforcer she issued you a valid ticket .......its like getting a ticket from a Forest Ranger and saying in court but your honor a Forest Ranger is not a Police Officer...lolol
 
since you aren't even sure if she had her sirens or lights on, I think you need to accept you were speeding.

You really think doubling your speed esp in an area where such a low speed is totally warranted is worth fighting?
 
Don't know about your state but here they actually define the legal requirements the officer has to be prepared to swear to when giving a pace ticket. It is really nothing more than being prepared to submit their last speedometer calibration report and testify that they paced you for 1/4 mile at the speed they say you were going.

I was just commenting on her choice not to issue a "reckless driving" charge, which I believe she could have since I was supposedly 20 over the speed limit.


The speed limit is extremely low, and very rarely enforced. Down the beach further it's a free for all(with 15mph signs posted every where). it's more of a beach freeway than a beach.

I did read up that not having your lights or sirien on while speeding is illegal, and thus they illegally obtained the evidence proving you at fault, and thus it would be thrown out. Similiar to an illegal search without a search warrant.

I have a while until I have to deal with this, so I am just trying to get some info before I start putting together my defence.

I had two fairly specific questions and so far the comments have not really addressed them.

#1 and #2 File a Motion For Discovery. Since I'm not a lawyer I have no clue how you would actually do that though.

Which I'm sure she'd do, but there's almost no way she could have actually paced me for the quoted quarter mile. I know exactly where I stopped, and the distance from the entrance I belive she started pacing me at, to where I stopped was literally .26 miles (google earth). So assuming that I came to an instant stop, she accelerated from the legal 15mph to my 35 mph in 60 feet, giving her an acceleration of over 10 m/s^s... means a 0-60mph time in about 3 seconds. I doubt her truck is capable of that.
 
Are we talking driving ON the actual beach, like on the sand? If so then I don't feel sorry for you, really shouldn't be driving that fast there.
