Last year I was involved in an accident where some guy cut across 3 lanes and hit my car on the driver side. There was substantial damage to my car but the insurance company opted to do the repairs to the car.
I have had the car since December 1998 and it ran perfect. Since the accident the car has been making weird noises, it would pull to the right even if I kept the wheel straight and other little things. It still ran fine but I knew it wasn't the same car.
I was planning on replacing the car this summer with a Insight but the other day on the way home I was rear ended by a lady who wasn't paying attention that I had stopped behind a large truck making a left. The speed limit on the road is 40 but I would assume she was doing around 50 and hit my car at 35-40 or so.
I was hoping that they would just total the car out being that it was involved in 2 accidents in the same amount of years. I called the other insurance company which has already assumed full liability (100%) and they said they were waiting for the adjuster. I then called the auto body shop and he said it wasn't too bad - just needed a new bumper and some other little things.
I really rely on this car as my daily commuter (120 miles r/t a day, 30,000/yr) and I don't feel like having it break down on me a couple of months after the repairs. Is there any way to deny the repairs and request that they total it out?
In my last accident the other insurance company cut me a check for around $1200 for bodily injuries. Since I was hit in the rear can I expect a bigger amount for my bodily injuries? Should I go after the other person and sue them in an attempt to get enough money to purchase a new car? I'm not sure of my options and thought maybe someone here could help me out.

So the car was totaled out - and theres a massive story behind what happened with that. I was able to get just short of $5500 for the car.
I went to my doctor because my back was killing me and apparently my doctor no longer does "no fault". I tried to see the doctor using my own insurance and the office staff said no and I was shown the door. They said there was a no fault doctor down the road but I don't want to go to a doctor that I don't know.
I went home and I took the medication I had left from my previous accident and I felt better. I had to stay home from work because I can't work while on the medication. I almost was sent home today as well but they waived the whole 72 hour thing (it was 68 hours since I had taken the medication).
I spoke with an attorney and we have a consultation set up for later this week. He said I have a very good case - who knows what that means.
