Got hit by an uninsured teenager.

Last thursday, I got into an accident when returning home from work.

I was in the middle of the intersection waiting for an unprotected left turn. Steady stream of cars zooming by along two lanes of traffic coming from the opposite side. Lights turn yellow. I waited for about another two seconds and surveyed to see traffic slowing down. On the far lane (oncoming traffic), the front car is already at a complete stop. On the lane nearest me (oncoming traffic), a white Dodge Neon was going less than speed limit (35 limit) and still have about 3 or 4 car lengths before coming up to the white line.

I'd figure I was safe to turn as seeing no car rushing to beat the light. In the process of my turn, however, out of the corner of my eye, this white Neon was beaming down the lane and T-boned me. This caught me completely by surprise.

What had happened is that this girl decided to try to beat the light at the last moment, the same moment I was already in my turn. So she hit me in acceleration mode. Luckily there was no one sitting on my passenger side.

No one was hurt. This girl had one passenger with her who was also a teenager.

A motorcycle cop came by to assess the situation and write a report. He wrote us both a ticket. This teenager had an expired permit, did not have an adult with 5 yrs driving exp with her, and also had no insurance.

I was surprised to get a ticket as well, for failure to yield. According to the cop, he believed I should have just waited for a red light before making my turn. I admitted to him that I saw yellow before making the turn. He explained to me that the person in the middle of the intersection has to be "extra" careful because the oncoming traffic can either choose to stop or drive on through. And there's not any proof that she went well above the speed limit. He indicated that I should go through a mitigation hearing to get the ticket reduced in light of the situation, but that he has to write the ticket in accordance to the letter of the law. 🙁

The girl, almost in tears, came up to me and repeatedly apologize. I just looked away and didn't even want to talk to her. Her mother, who was called to the scene, pulled her away telling her not to talk to me.

Her '95 Neon is drivable with damage only to the front bumper. My '04 Accord front passenger door is crumpled. The front suspensions are screwed up so it's not drivable.

I have full coverage on my car, but I just hope my insurance doesn't go up after this.


 
you are SOL because you got a citation...if she was the only one who had a citation, you could take them to small claims court and easily win
 
Stuff like this used to bother me, but after having enoguh cars stolen, broken into, danted, etc. I don't really worry about it as much any more. It's still annoying when someone else damages my car, but meh, what can you really do about it except call the insurance company?

Sucks that your car got hit, but don't let it ruin your week.
 
Yeah, I got hit by an uninsured idiot a while back, and it was completely not my fault. My insurance company is going to go after the guy personally but I think I'm pretty much just out my deductible as I doubt they'll get anything from him.

Sounds like the cop got it right to me...

You'll probably get the ticket waived off in traffic court anyway...

I don't see anything about how old she is, other than "teenager", but in MOST states, if she's under 18, her parents are responsible for the damages...Since you also got a ticket, you insurance will probably assess you at 50% at fault, and yes, your insurance may indeed go up a bit. You MAY need to hire an attorney to recover your damages.
 
As was discussed in another recent thread, you might want to find out if your state allows persons to run yellow lights. I think most states allow a left turn on a yellow light if you are already in the intersection waiting on traffic. However, it may be possible that the girl broke the law by running through on yellow. This might be the advantage you need to win this situation.

Nope... it will actually make it worse.

The problem isn't the age of the drivers, per se... rather, the it's the driving experience of the drivers.

Whether you set the age at 16, 18, or 21... for the most part you will see the group with very little experience involved in a large share of the accidents.

But by raising the driving age to 21, you've just now create thousands of unregistered drivers who will carry no insurance (since they aren't supposed to be driving for a few more years).
 
That's one of those situations that we all do but sometimes it backfires. We get used to what most people do in certain situations and when they do something else (like speed up at the last second to beat a light) instead of what we're expecting, we're at fault. And teen drivers can be unpredictable, unfortunately.

Not much you can do. I'd expect your insurance to handle the damages for both cars since you turned in front of her.

You almost have to carry full coverage these days, since so many dolts are driving without any insurance.

Sounds to me like the accident is at least 50% your fault. Sorry.

Yup. If you're making an unprotected left turn it's almost ALWAYS your fault. Sounds like she didn't get a ticket for the accident, just for the lack of license and insurance? The OP is probably responsible for the girl's damage too, although without an insurance company to back her up I doubt she'd go after him for that. Unless the light was red when she entered the intersection, she had the right of way. The fact that she had no license and no insurance does not negate that.
