Wait wait wait...the judge, the person who will decide your fate, told you to plead not guilty? Uhhhh....I'm no lawyer, but thats a pretty big hint as to what your next course of action should be.

OP is an idiot. It's not like you didn't know you couldn't drink... and if you're going to break a law that is heavily enforced you could at least not be stupid enough to do it in a place with 30 thousand people.

You are on a probationary liscense, last I checked, that means that you need to watch out for yourself. You clearly didn't.

Yeah, you need to realize that the prosecutor does NOT care about your best interests. He is paid by the state to prosecute violations of the law, so when he tells you what you should do you take it with about a pound of salt.
 
OH, BTW, how old are you? Are you in college yet? Most Universities have student legal services that you can consult for free, and they'll work with the prosecutor and deal with their BS so you don't get taken for a ride...

?? How does drinking a beer at a ball game have anything at all to do with driving? Why should he lose his license? I don't understand, are you saying that anyone who drinks alcohol should not be allowed to drive?

If the hearing judge is the same one as the trial judge, plead not guilty. If the hearing judge is not the same as the trial judge, plead guilty.
 
i got "arrested" at a diamondbacks game for intoxication. No possession of alcohol, but I was in the company of two girls who were purchasing alcohol with fakes. Those girls got shafted, my buddy and I were very polite to the cops, who proceeded to write us up anyways and kick us out of the ballpark. We went to court a month later. A girl a couple rows in front of us pleaded not guilty for the exact same offense as us. She got ankle bracelets, random drug/alcohol testing, banned from the BOB (or chase field) for a year, and alcohol classes. Needless to say, my buddy and I were like oh great.

We got in front of the judge, case dismissed. No paperwork was ever received in regards to our arrests. I think it was a pretty good move on the cops part. We obviously sweated our asses off for a month and that whole day, and they taught us a small lesson but at the same time realized that we weren't belligerant and for my buddy and I it really was wrong place, wrong people, wrong time.
 
oh yeah, freakin phillies stadium. Paid $40 for seats and couldn't even see the damn jumbotron thing
 
I agree with that judge, if they didn't card you for buying the beer, you shouldn't be held responsible. that was the first thought that came into my head when i read the thread title.

Generally speaking, you don't have much leverage because a) you are underage and b) you were drinking. You'll have very hard time trying to dispute those two facts. I'd take the plea bargain.

Are you 12 years old or something? You don't have to show your ID to anyone, unless you're driving a vehicle, so even if some rentacop spotted you drinking, you don't have to prove that you're 21.
 
Can we point out as few things...

First and foremost I seriously doubt that the judge said what was claimed..

Second of all you knew you were underage yet YOU decided to try to purchase an alcoholic beverage anyways....

Third of all-- blaming them for not carding you is inmature and a stoopid excuse.

Fourth of all....This whole problem would not have happenned had you not decided to attempt to purchase beer....which you knew was the wrong thing to do...

God I love kids who try to blame others for there mistakes!!
 
I got arrested for underage gambling when I was 18. I learned a valuable lesson. When they ask you how old you are, lie. If they ask you for ID, tell them you left it at home. I would assume the same thing applies to underage drinking.

im 18, so not on a cinderella license (as if that matters anyways). i shouldnt have even said anything about my accidents, you guys are focusing on that. im asking for advice on what to do in this situation and you guys are debating whether or not i should drive. we all make mistakes, act like you guys have never made any.
