got a ticket for riding my bicycle

So an undercover (or off duty?) cop stopped me a couple months back. i was riding my bicycle and pulled up to a stop light with two lanes-- i pulled into the left turning lane and waited at the light. the cop was in a beige suv behind me and yelled something at me. i didn't know he was a cop so i just pointed left like i was gonna make a left turn and waited at the light. he then pulled in front of me , and yelled at me out the window to pull over, so i was like ok and did. i never even got through the intersection, so i told him, i didn't run the light and asked, "what did i do?" he said, "you have to stay behind me." so i played it cool and I was nice and said "I didn't mean to be in your way, officer" he said, "well, you were," and got out his citation book and started writing me a ticket. So i asked him, "you can write me a ticket for that?" He said, "you have to follow the same rules as cars", and kept repeating something about roadway devices. I said, "yeah i'm sorry i didn't know i couldn't be in front of you, i needed to make a left turn so i got into your lane."

Let me describe the situation better: so he was stopped at the light to make the left and i pulled in front of him and waited for it. there was room for me in front of his car and i wasn't in the crosswalk or anything, but i guess his beef was that i passed him while he was stopped, but im pretty sure im allowed to do that in my state. my PA bike handbook has a whole section about passing slower moving traffic, you just have to do it on the correct side like you were in a car and i did.
When it was clear to me that i wasn't going to get out of this ticket i asked him how much he was writing it for and he said $100! At this point I was a little pissed because I was nice to him because i figured he was having a bad day or maybe really needed to be somewhere but didn't have his lights on cause it wasn't and emergency, i don't know. But I really can't afford this, so i figured i would have to fight it in court. he handed me the ticket and all it said in the infraction column was "failure to follow roadway devises [sic]" I told him to write down exactly what i did, i don't know what that means. i mean, i didn't want him to just be able to make anything up that he wanted later on in traffic court. so he said "oh i will", handed me the carbon copy of the ticket and got in his car and put the window up. i could see him writing more on my ticket, none of which is on my copy so i don't know if he was writing that i got in front of him like i asked him to, or that i tried to punch him in the mouth for that matter. and then he just drove off.

i cooperated 100% so he didn't taser my ass or anything, but im still angry about it and my court date is on the 20th. ive never gotten a ticket (on a bike or otherwise) or been to traffic court so i don't really know what to expect. should i say that i dont know what's on the copy of the ticket he filed, is that worth making a point of? i assume they wouldn't give you a copy to plead not guilty to if you weren't supposed to look over the charges and say, "oh i disagree to that". Or should I just tell the judge that I thought it was ok to pass a car to get into the turning lane like that, even though he was stopped? help me out here guys.
 
How did he know who to write it for? Did he ask you for your id? I've always wondered how they issue tickets if you're not in your car and say you don't have any ID on you
 
Is PA one of those states where if the cop doesn't show up to court, you don't have to pay?

I really don't know if I could think of a greater waste of taxpayers time than having a cop take time off the street to fight a ticket he wrote out to a freaking bicyclist.
 
yeah, he asked me for my driver's license 1st thing and i gave it to him. i wondered about that but i know they can just haul you in or look you up or whatever? i really didn't know he was giving me a ticket at 1st
 
What made you think that was a good idea to pull in front of any car in traffic, especially a turn lane? I've never thought of doing that. You talk about it as if it's a common occurrence.

my friend got one for doing 55 down the hill between here and payson... anyone that has driven that road knows which one i mean. he got up to that speed because the hill was longer than he realized, and he just couldnt keep his speed down. the cop followed him until the next uphill, then stopped him and gave him a ticket... halfway up the hill. ouch. my friend told me he was praying the whole time he wouldnt wobble and die, it scared the life out of him.

That is ONE BAD ASS BIKE!
My bike that I exercise on SUCKS, bad enough the wheels need rebuilt but they are also bent, yes even the front wheel, let's just say going over 15 MPH makes me weary....

OP: does the ticket even mention that you were on a bike? Plead innocent, tell your side to the judge, and maybe he'll dismiss it. At least say that you did it to be safe - the front car (which you didn't know was police) would clearly see you while sitting there, you can easily out-accelerate from a stop, and be to the right side of the road before the front car got through the intersection. Anything else would have left you sandwiched between cars while trying to turn and not as visible, leaving you much more at risk of injury.

edit: there were no hills in my area where I could hit 55 in a 30 and be able to stop before a stop sign. I didn't want to die in an intersection! There are plenty of places in this area to hit 50+ on a good road bike. But, none of them (that I can think of) have 30mph zones heyyyyyy, I thought of one.

My uncle got a speeding ticket from a cop on a bicycle. No shitting.

He was doing 30MPH+ in a 20MPH and the cop huffed it behind him and my uncle got caught at a red light.

yeah, it is for me i guess. im a bike messenger and this happened in downtown pittsburgh. the funny thing is that there are so many things i could've been busted for before that were probably my fault, and i would've just taken the hit, but never had a problem for two years. the traffic cops here really dont seem to care about us and there are a lot of bike cops i am cool with, who do pretty much the same thing as me all the time. also this was my last day at that job! i think because he was undercover or off duty he'd never driven in town much and thought i was trying to cut him off or something. a lot of people commute by bike here. if it was something like running a light i wouldn't even be posting, its just ironic i guess.
 
I also hate it when bicyclists and motorcyclists just go around cars just because theres a little gap and they can fit in between there.

While I appreciate that logic, it's still illegal. A car cannot legally cut into a left turn like that, and a bike cannot either. Safe or not, it's still not a legal maneuver for a vehicle.

best thing to do is exactly what the good Dr said....go to court and give your side and add all the good stuff about doing it to be safe etc...also don`t be a jerk be super super polite. Do not talk bad of the cop at all!!

Also if the cop was off duty at least in california he can`t do shit except to maybe do a citizens arrest....or detain you...just because somebody orders you to pull over even if they say they are a cop you have a legal right to ignore then if the car is not marked and you can say you ran for fear of your safety....how did you know he was a cop...lol

It is still worth it for the kid to go to court and try to use what Dr Pizza said. Even though we all know and agree with what you said!!

I agree. It pisses me off when I see someone on a bike or motorcycle go whizzing by the side of my car and get in front of me while im stopped in any lane.

I would take my ticket, laminate it and put it in a prominent position in my house
 
yeah the ticket says make and model and he filled in "bk purple". my bike is not purple, its blue. he had a badge around his neck and showed it to me when he pulled in front of me so i knew it wasn't just some weirdo. people yell crazy things at me all the time, though

For the most part the bikes will beat you through the intersection and ride on the right side when you catch up, and you certainly aren't going to get slowed down by the motorcycles, so are you just worried they're going to scratch your paint?
 
check your local laws, in many places, its okay for 2-wheelers to "split-lane" and pass stopped traffic

also, if you go to court, there is a 2% chance the pig will show up

he was stopped, i didnt just pull in front of him-- i signaled. im sorry if i cant just pass stopped cars but im not gonna sit in traffic while my packages get old and pretend im a car. i needed to be in that lane and i waited at the light. people don't realize when they're rude to me that im making it easier for them by reducing the amount of traffic clogging the roads. can you imagine a row of bicycles sitting for miles waiting in line? that's ridiculous!

also, the cop was not cool to me and i was totally nice to him. he even said, "this is why you guys get hit all the time!" WTF. seriously, the bike cops here are mostly overweight in sweatpants with gunbelts, ready to fall off their clunky mountain bikes and they run lights all the time. most of them are cool and will say hi to me and get rid of the bums who try and shoot up in market sqr, so i dont mind em. oh and i didnt think to check if the cops car was marked at all
