WTF were you doing going 78 in a 55?

That really isnt that big a deal. I speed that much all the time. I am sure a lot of people do.

And, really, I would just pay the ticket. There is no way of getting around it. He got it on his radar gun and has full proof. I mean you cant really say you werent speeding and I think it would be hard to come up with a valid excuse for going 23 over, besides "I was being chased by a bad guy" lol.

File not guilty, request trial by affadavit and call the DA and see if he'll offer a reduced charge for your plea of guilty. Works every time.

What state you in?

If you are in California you should request a trial by written declaration.

My excuse is that I felt the speed I was driving at was safe, given the time of day, and the number of cars on the road. It was 1:50 in the morning!

Many states have a "Traffic School" that you can take if 1) you plead guilty 2) it's your "first offense".

This amounts to a probation, usually for a year, after which time the ticket is dropped. In Illinois, this is not reported to the Secretary of State (or your insurance).

Keep in mind that if you fight the ticket and lose, you'll also have to pay court costs ... which can more than double the ticket (depends on city, county, state ... charges vary).

Traffic School / pleading guilty will also be the fine + costs, but the costs for a summary trial (if you plead guilty at the arraignment, the process stops there) are much less than the costs for requesting a trail by {jury, affadavit, anything that costs the court more money to stage}.

And, it's not that us "Traffic Nazis" don't speed, it's that when we get caught, we admit it and take the consequences. It's a "grown-up thing."

The court is never going to let you slide just because you felt you were still being safe. One person's version of "safe" can easily be "reckless" in the eyes of the arresting officer and the state.

Good Luck

Scott

go there and plea guilty and ask for the points to be dropped + probation. you will pay the fine and the ticket will go off your record after 6 months or so, unless you get another ticket in that time.

Talk about dickheads!

Most everyone here who got bagged breaking traffic laws, took it like a man and paid their fine without whining and trying to weasle their way out of it.

that doesn't give you the right to get on your high horse everytime someone comes asking for some advice...

I've sped plenty, only been caught a few times, but only recieved warnings so far (country cops)...

Always plead not guilty, show up on trial date then you will meet the DA first before going to the judge. The DA will often reduce your speeding charge to lesser fines without points unless you have a bad driving record.

What state do you live in?

See if it offers:
1. Deferred adjudication - if you've had no tickets in the past 3 years, you can pay the fine and it won't affect your insurance if you don't get another ticket for 6 months.
2. Traffic school - pay the fine, go to traffic school, doesn't affect insurance
3. Trial by written declaration - probably not your best option, since you'd have to lie and say that you weren't speeding.
4. Get a lawyer. Plea bargain down to a charge that doesn't give you any points.

Um...it's not that those 'holier than thou' have never sped in their lives, it's that they don't try to weasel their way out of it if they do get caught.

Fight it

like how should i fight it though? im doing a google search right now, and all the ticketing fighting sites say "plead not guilty"

but like i cant just lie.

if i plead guilty, is there any way they could let me off with less of a fine?

well, if you like just can't lie, then pay like your ticket and try not to like speed anymore and stuff. just be a man like and own up to your own like mistakes. yommsain' homs?

Yeah, get court supervision/traffic school whatever. You'll pay the fine, but if you dont get a ticket after x amount of months it wont stay on your record.

pay it since you were speeding?

WTF were you doing going 78 in a 55?

the 55 happened to be a 3 lane highway hardly populated by any cars, it was 2am. I felt completely safe at that speed.
plus the speed limit was just about to change to 65.

I speed all the time, and if I get caught, I'm ready to face the consequences. But saying osmething like "oh the speed limit was gonna change to 65" makes you look even more like a dumbass. You do realize that even at a SL of 65, you were still SPEEDING.

BTW, your ticket should say whether or not you can request a defensive driving course as a means of dismisal of the citation. At least in Texas the citations offer you that choice on the ticket itself with clear instructions on how to go about doing that.

like i said, that doesn't give you the right to preach to people who want some advice, and 'preach' is what a lot of you do...

let's see. you were going 78 in a 55 zone.
you told the cop you were probably going 80
now you want to fight it?
wtf??? just pay the goddamn ticket. take responisbility.
the only way you should fight a ticket is if you weren't speeding and they gave you a ticket.

Yep, happens everyime someone gets a ticket. Just admit guilt, pay it, and learn the lesson. Stop trying to justify breaking a clear and obvious rule of driving... that's really all there is to it.

Rules of driving should be enforced to protect safety, not to be nuisance nor to enrich the city's coffers. Many traffic laws do only that. A three lane road, two in the morning, no traffic - no safety issue, but the ticket will stick. The city and the insurance company will be paid and the cop will get promoted. The system works!

no safety issue? what about the safety to himself?
what if he loses control of his car? that means police, fire, ambulance, and whatever other personnel will need to come save his ass or worse, come take him to the morgue.

officer said he clocked me at 78 in a 55.

What he clocked me at was probably accurate. I told him i figured i may had been doing up to 80, when he asked how fast i thought i was going.
fine is $135

is there any way to fight this in court? Is they only way that they would let me off easier would be if I pleaed as not guilty?

Like I cant just lie in court, that would be purgery and i could get in serious trouble for that.
so what are my options??

You admitted your guilt to the cop. Pay the ticket and go on with life.

Traffic school FTW.

You have to pay the fine + traffic school fee (in CA at least) but you can keep the points off your record that way. My wife just did that for a speeding ticket.

I always fight them just to make the cop earn his promo. If everyone fought them, cops would only ticket for serious violations. If you fight it, the cop has to show up in court. I got one last summer in a small town in Georgia though that I didn't fight. The cop actually checked his radar with tuning forks before he wrote the ticket. I was so impressed that I paid it. Everyone I have fought except for one, I have won. I've heard several cops lie before the court and have proven a couple did just that. I don't get that many. I'm sixty and have gotten maybe six or eight tickets over a lifetime. I always try to obey the law, but sometimes the city will do sneaky stuff like moving speed limit signs (Oklohoma City) or try to stick you with the expenses (Arlington, VA) with a bad charge and a crooked DA. If no one fights them, they will have no limits.

Wasn't trying to justify the attitude. But those of us who have had tickets and just paid 'em (or asked for traffic school) generally aren't copping the atitude. 😉

I'm just saying not to fight a ticket when it was justifiable. Especially when the OP admitted it to the cop.
