got a speeding ticket and I'm guilty, but have a question?

I was caught by a helicopter clocking people and chp sitting on the side of the rd pulling the speeding veh over..doing 82 on the freeway which is 65 speed limit..my question is a technicality, all the info on the ticket is correct, except my vehicle is a 99 not a 00 and is beige not silver, do you think i could use this to get out of the ticket??
p.s. cant do traffic school so i need to get out of it!
 
Very unlikely. When I got my first ticket (careless driving contributing to an accident :|) the cop was a total dumbass & wrote down a time two hours off - I was at work at the time he wrote down.

I asked my grandpa who's an ex-cop if it was worth bringing up in court, he said no.

Worth a shot, I guess, but I doubt they really care that much about little crap like that. Besides, color is totally subjective. The cop called my red Tercel orange, too. Go figure.

Yes, absolutely it's worth taking to court, not only on the technicality, but also the fact that many times tickets get thrown out because the cop doesn't show up, there's a mixup in the paperwork etc etc. It's worth a shot......
 
82 in a 65... you in oregon??

just bite the bullet, suck it up and live with it......

sorry man.... I have never had a speeding ticket (knock on wood) but when I do, I know I deserve it. atleast for all the times I have never been caught.
 
Call the courthouse of where ever you got the ticket and find out what your chances are of pleading to lesser charge.

Or, if you got the dough...Get a Lawyer, they might be able to get you off ENTIRELY! At a cost.
 
yea, the plate number is correct..CA CHP sux..my last ticket was 16 months ago..no traffic school for me..I will also lose my good driver discount which is a 25% off on my insurance premiums🙁
 
If it's your first offense plese no contest and typically, if it's your first offense they'll reduce the violation from like 17 over to like 10 over and you'll lose less points. The fine will probably stay the same though.

Get to court on time, as others will be there early. They usually call in the order you arrive. Why do I suggest this? Because then you can get a feel for the judge and how everything works.

Typically I plead not guilty, then go talk with the city/county attorney and work something out. Not that I've had a lot of tickets, but enough to have know this. 🙂
 
Get a lawyer. They usually advertise specializing in traffic tickets. The fee a traffic attorney will charge is less than the cost of the ticket, and almost all of them guarantee that you will either get off completely, or have no points on your license. I have used lawyers twice (92 in a 55, and 97 in a 65) and got off both tickets without even having to show up in court.

I do not know how Ca law is, but in Fl it is easy to beat tickets. Consider the fee you pay the lawyer your penalty for driving too fast. Don't let others give you a guilt trip and plead guilty or go to traffic school. Traffic school is for losers.
 
Fight that b!tch. Request continuances up the ass. It works even better for aircraft tickets because BOTH the pilot and the officer must show for the trial.
 
I'd also recommend a lawyer. No sense adding tickets to your record when you don't have to.

I only wish I'd had the money when I got my speeding ticket, freakin' 72 in a 55. I do NOT need that on my record.

I have a question on this topic... I got a speeding ticket going thru Ft. Worth on my way home from Dallas.. I think it was a 91 in a 65, although I was really doing over 110, but I saw the cop after it was too late and slammed on my brakes and I had slowed down to 91 by the time he clocked me..

it was a cop in a Z28 Camaro pursuit car too, how ironic.. :|

anyway, I took traffic school a few months ago for a ticket I got a while back, and the rule in TX is you can only dismiss a ticket like that once per year, but is that per county or state-wide? I requested to take defensive driving to drop the ticket, I haven't heard back from them yet.
 
Yes it can be brought up in court. If the cop cannot determine what model year your car is, then how can he accurately determine what speed you were going at (I'm playing Devil's Advocate here)? You can try and paint the cop as being careless and the type of person who doesn't pay attention to detail. You should probably take note of how the weather was too. Here in Canada, you can question the officer and the more you make it seem like the officer cannot remember the incident (i.e. ask him how the weather was...you'll know but not him!), then the greater chance you have at knocking down the ticket or getting a not guilty verdict.

If he's a careless cop that doesn't pay attention to detail, then chances are that the radar/laser wasn't calibrated to any degree of accuracy either. You could probably get away with telling the judge you were doing less than 82 but were indeed speeding, and plead guilty to a lesser charge.

I hear that in CA, each county keeps a separate record, of traffic schools, so it's quite possible to take it multiple times as long as it's not in the same county.
 
i'm pretty sure your outta luck Valhalla1 - all the tickets are fed through Austin, and I'm pretty sure that its statewide...
 
People have sometimes gotten lucky when the cop who pulls them over doesnt show up to court. Its a crapshoot. Its not worth it.

REGARDLESS of minute details on the ticket, you will lose.

Cops DO show up these days, they can be fined heavily for not showing up.

Your best bet (If it's you first offense) is to go to court, plead No Contest, and more than likely, the judge will withhold adjudication, and you will have to pay court costs. I wouldn't hire a lawyer (unless it's your 2nd, 3rd, 4th violation, etc..) as it may cost more to hire a lawyer than to simply pay it and the increase in your insurance.

Believe what you want to, this is the Matrix after all 😛 All I know is that a few months ago, family friend fought his speeding ticket, delayed his court date three times, went in thereafter and the cop didn't show.
 
In Brevard county Floriduh, they are not fined. Their supervisors give them hell but not fined. 😛
