Good shoot or murder?

Yeah I realized after what he was getting at. That would seem a huge stretch to me.
 
Being in a situation where you have to shoot someone to prevent your own death is never good.

However, from the details present in the article it looks like a justified shooting in self-defense.

The only way it could be murder is if the shooter planned to provoke a group of kids into beating him up with a baseball bat so he could shoot them... um yeah.

Also one of the teens presumably fled or possibly was held at gunpoint until authorities arrived. Indicating to me that the shooting stopped when the threat to his life was ended.

Unless some shocking details come out the article is describing an act of self-defense.

Would your opinion change if you knew the shooter had an extensive felony criminal record? I am betting the shooter has a record and that is why they are holding him. If he has a record, he can't legally have a gun. If he can't legally have a gun, he ultimately can be charged and imprisoned for that.

You probably should have said in the OP that you wanted to speculate hypotheticals. As it stands you asked about the merit of the case and haven't really discussed any of it.

That article told me something interesting. In WI the police CANNOT disclose who had a concealed carry permit.

thats a far cry from NY which publishes them in the newspaper.

So, there were 3 total aggressors, but only 2 were shot? I'd love to know how all that went down, sounds like the old timer was extremely lucky. It's usually kind of hard to draw a gun and fire accurately when people are holding you down and beating you with a large blunt object.

Do we have Trayvon/Zimmerman 2.0 on the way now? A guy on the ground fearing for his life had to use deadly force to stop the attack. I guess we'll find out soon if he was white.

Yeah what a bunch of crap. Making someone who initiates a conflict have to exhaust all possible options if it backfires before they start shooting.

You really are the poster boy for who gun owners should fear when it comes to promoting the cause.

Stand your ground laws typically say you have a duty to retreat if you are the initial aggressor. Nice try though, you clearly know jack shit about self defense laws.

But that doesn't apply in this case at all.

Very similar to what other states have. Even if he started the argument, the final point of escalation is what is key. Being held down while being beaten by a deadly weapon (If that weapon was only possessed by his attackers prior to the shoot) pretty much gives him the right to self defense.

As with anything , there may be details we haven't been told yet.

Prosecutor would have to prove intent was there prior to the physical aspect of the fight/escalation... 3 against 1... Highly doubtful.

You can not hold someone indefinitely without charging them. At anytime he can ask if he is being charged and can he go free.
