As I said if you read either of the two threads, I am more than willing to pay the fine, and take the consequences of 70 in a 65, but I know I was not doing 83. I also am not trying to break the law by getting the sentence reduced. This is offered by the DA or ADA present.

I'm assuming you got nabbed on the Thruway down around 21b right? The troopers seem to like picking people off around there after leaving the prison. Anyway, I think you're going to have a very rough time trying to plea that down to a no points violation. In my experience, most of the troopers around here aren't very flexible and if his radar says you were going 18 over then you were going 18 over regardless of what your speedo said... But you can always try I suppose. At least you weren't a little more north to where you would have to come to Ravena or Coeymans, being that they are pretty small towns they try to get as much revenue as possible out of you..

I would honestly say that 90% of cops are worthless, and barely better than the criminals the good 10% protect us against.

The New Melle Speed Trap BABY!!! I was about 18 when I first drove through there, and a guy has a sign in his yard right before town that says "Speed Trap, Beware" on it. I slowed down to the RIDICULOUS 35mph on a 2-lane highway with no stoplights, and sure enough, right in city limits there was a cop hiding there.

Awesome.

The judge allows you to pleady guilty but keeps ticket OFF your record unless you get another ticket in the next 6 months.

you still pay fines and etc... but your insurance doesn't go up.

If you are absolutely sure your speedometer was registering a proper speed, you can always go nd get it calibrated.

You can then argue it down from 18 over to improper equipment or something like that. Call around and ask if anyone does speedometer calibrations.

Oh, and court costs are nothing like $100...more like $20. Of course you still gotta pay your fine, in addition to your court costs.

Everyone I know who has gone to court has gotten a reduced sentence. Usually, the prosecutor will offer you something, but if not, you can ask them to give you a no point infraction. They usually will if you have a good record.

If you must go before the judge, lie and say that you were going the speed limit. It's your word VS the cop. I am telling you from personal experience. If you say you were going 56mph in a 55mph, you are still breaking the law. It's like a thief saying that he didn't steal the guy's wallet, just a few dollars. It's all or nothing.

If you are unconfortable lying to a corrupt money grubbing system, then tell the truth and hope he is a nice judge who has better things to do than throw the book at speeders. When I was in court for my last one, the judge gave the people ahead of me $45 court costs and no points on their license. (like 3 of them) My case was dropped for unrelated reasons, but I am sure I would have gotten the same thing.

Seriously though if your record is clean ask for a reduction say 74 in a 65 and plead guilty to that. No points on your license and the state gets more money to waste...all is happy

74 in a 65 is still 3 points. In NY, if you are caught doing 1-10 over (or an undetermined amount over), it is 3 points.
