You're absolutely right ... and then we get back to ... is it worth it to drag something out, 'cause I'd lovveee to have the moolah in my pocket. I don't need it, but it's mine, and I want it.

This is why I'm wondering if after I get the $$$ for this check, if I can go turn on the previous bad checks that I already went through the grater for. Not to win $ from him, but to let the state deal with him, as it's commonplace for him to write bad checks ... apparently.

Real motive: I know over 10 people who have left the company for various reasons ... some were let go, some moved on ... Everyone has a problem with this guy. 3 of my closest friends who worked there got bent by this dude. So it's like a vendetta for all of them.
 
I did some looking around, and I haven't been able to come up with a definitive answer on what happens if you cash a bad check at a check-cashing service. PlatinumGold implies you would be in the clear and the service would have to go after the check writer. I'm not so sure they can't come back on you as well.

It would be an interesting thing to find out, because it seems too easy that you could cash a bad check at a service and they are stuck while you're in the clear.
 
kranky - I'm not sure how those check cashing places work (other than charging you an outrageous % just to cash a check). However if the check comes back NSF they aren't just going to give up and eat the loss. They'd be out of business by now. I'm sure that they'll require one or two pieces of legal ID and WILL legally pursue the individual if it's worth their time.

If the funds aren't in the checking account, you're basically screwed.

This is why you shoul ONLY ACCEPT GUARANTEED FUNDS - MONEY ORDER OR CASHIER'S CHECK.
 
Aren't there several laws about writting bad checks?

Id take it to the bank, then when it bounces call whichever law enforcement agency they suggest.

Ive always been told it is illegal to write a check you dont have the money for.

possibly, but i was under the understanding that it was like selling a loan or a Receivable. IF the receivable is legal and all the paperwork is in order, and i sell it to a company (40% of value or whatever) then they are responsible for the collections and they can't come back to me and try and collect it from me. they take on the risk.

i understood check cashing to be the same principle, they charge you an exorbitant amount (and i don't know what the percentage is) and it is THEIR responsibility to collect, what they need to confirm is that it is a legal check etc. once his boss writes the check, he has a legal obligation to fulfill that check. the check cashing place is taking that on, charging you an amount to take it on and it becomes theirs. so i'm not sure that they can get back at you for it.

Do I have to send a demand letter before I turn him over?

I have 3 checks from the last year and a half with NSF stamped on them, sent to me from the bank ... think that's still applicable?

This is interesting. I didn't want to put it in the bank because then it's like a whole hassle in 2 weeks when they shank the money out of my account. I have to go ask for it again, yada yada ...

Well, first off, its not a "bad check" until you take it to your bank. This is what you would have to do.

1. Deposit it in your bank
2. Wait for it to bounce
3. Send him a certified letter(the one that was posted in this thread)
4. Wait X days if no response hand the check over to the DA along with reciepts and copies of the certified letter.

In Texas if someone does clear it up in 10 days from receipt of the letter, it goes to the DA. As for past checks that bounced, if the company eventually covered tham, there is technically no harm. Im pretty sure they covered the checks or you wouldnt have been working for them.

In the end since this is a check well over $1000, you will get your money + NSF fee, or he will get convicted of a felony. Its highly unlikely he will risk being convicted.
 
Just FYI, you can make unlimited attempts to cash a bad check for 6 months after it was written. Every attempt means an NSF fee to them.
 
In order to get this thing off my chest for a bit (it's driving me to the boiling point) ... I went to the bank.

His bank won't NSF a check that hasn't been dinged by another bank.

My bank said to just deposit it and wait.

So I did.

In about 10-15 days I'll get it back in the mail ... and get -$ on my account. Then I'll send him a 7-day notice, and legally 5% more fee.

Then he'll comply (he's a dick, not a dodo) ... and I'll go to the DA to see if they want the other checks for criminal charges.

I just extended this piece 3 weeks by doing this :\
