CUEVAS INVESTIGATION UPDATE
FRESNO, CA (July 27, 2005) ? The City of Fresno has received numerous inquiries regarding the
arrest and detention of an eleven year old girl. A recent media story containing numerous
inaccuracies questions the actions of the arresting officers and greatly minimizes the severity of the
assault. After learning of the incident, Mayor Autry stated ?I commend the Police Department and the
action they?ve taken. This incident has been distorted and misrepresented. In Fresno we love our
children too much to treat this like it was just a childhood dispute, when in fact the consequences could
have been tragic.?
Fresno Police Department Chief Jerry Dyer is releasing additional information on this felony assault
case.
On Friday, April 29, 2005 at 5:06 P.M., officers responded to a 9-1-1 call of a boy who was riding his
bike and was hit in the head with a rock. The caller said the boy had a ?big gash and is bleeding.?
Upon officers? arrival they learned that an 11-year-old Hispanic female struck a 6-year-old Asian male
in the head with a jagged-edged piece of river rock. Since then, there was some discrepancy on the
ages of the involved parties due to language barriers; the officers understood the female to be 13-
years-old and the victim to be 6-years-old. According to information obtained by the officers, the
suspect was 5?00? tall and weighed 130 pounds; the victim was 4?5? tall and weighed 68 pounds.
The following information serves to clarify the inaccuracies previously reported:
1. Police apparently came prepared for gang warfare when they sent three squad cars and a
helicopter in response to a 911 call.
The Department did not initially send three squad cars and a helicopter to this call. Originally, one
two-officer unit was dispatched. During the course of the investigation, an assisting officer was
requested due to the female suspect physically resisting the officers. A supervisor was later requested

due to an officer receiving injuries, which is consistent with Department policy. Additionally, a
volunteer unit was dispatched to translate for the investigating officer. An Identification bureau
technician later responded to photograph the evidence. In total, three officers, one sergeant, one
translator volunteer and one I-bureau technician responded. At no time was a helicopter requested by
officers or dispatched. It is not uncommon, however, for a police helicopter to fly over calls involving
disturbances.
2. Instead, they found an 11-year-old girl who had thrown a rock to defend herself?
What the article failed to mention was a jagged-edged river rock, with dimensions of 5 ½? long by 3 ¾?
wide, weighing two pounds, was the object which struck the victim in the face, causing a deep gash to
the victim?s forehead, requiring several stitches. (See attached photo)
3. (suspect) says she didn?t mean to hurt the boy
Through the course of the investigation, the responding officers determined the suspect had the intent
to injure the victim based upon a statement she made to the officers.
4. several other boys pummeled her with water balloons
The officers determined the victim threw one water balloon at the suspect. The suspect then retaliated
by throwing a river rock at the victim. There is no indication that any other boys were involved in this
disturbance.
5. Maribel, who speaks limited English, spent five days in juvenile hall with just one half-hour visit
from her parents. She then spent about 30 days under house arrest, forced to wear a GPS ankle
bracelet to monitor her whereabouts.
Once the suspect was booked into Fresno County Juvenile Hall, her length of stay, visitation rights and
ankle monitor-release became decisions of the Courts and Juvenile Hall, not the Fresno Police
Department.
6. The officers ?grabbed me from behind, by my shirt? the girl said in Spanish, ?I was so
scared?.I didn?t know what they were doing.?
Officers, realizing that a felony crime had occurred, decided to escort the suspect to a patrol car. She
physically resisted the officers and scratched one of them on the arms. She also threw herself to the
ground and began kicking towards officers. The officers exercised restraint in controlling the suspect
and did not resort to using any force beyond physical control.
The circumstances surrounding the arrest are currently being reviewed by the Department?s Internal
Affairs Unit to ensure the officers? actions were within Department policy.
Chief Dyer is additionally releasing four photographs from this investigation. The photos will show the
victim?s injury, the rock used, and the scratches sustained by the officer. Additional facts in this case
are being reviewed by the District Attorney?s Office, as this is still an on-going investigation.
Unfortunately, due to both the victim and suspect being minors, we are unable to release further
information at this time.
In response to Mr. Beshwate?s statement that the Department ?overreacted and won?t back down?.I
don?t know if they don?t like Spanish speakers, if it?s racism, or if they were having a bad day,? Chief
Dyer said, ?Neither the race of the suspect nor victim in any way influenced the decisions made by the
officers. It is unfortunate that the Associated Press released one-sided information containing
numerous inaccuracies. This reckless reporting has served to not only misrepresent the Fresno Police
Department, but our community as a whole.?
