Long story short... This McDonalds sucks, bad. They have unusually low health scores on their inspections, they hire mentally handicapped people from the barber center and have them cooking food (is that even legal?). My uncle is mentally handicapped and lives with me, so please dont tell me im being heartless or whatever.

Moving on: Can we sue for the price of her treatment? Furthermore, can we sue them for a lot more based on the seriousness of food poisoning (you can be hospitalized if you get dehydrated enough).

Highly doubtful.

I had food poisoning from a Karl Straus restaraunt. I had fish there and I KNOW that's what did it for me. I hadn't eaten anything else that day that could have done it. I barfed all afternoon and half the night. That sucked really bad. I just won't eat there again.

Go ahead and have her sue. In fact, any time anything bad happens in either her or your lives, go ahead and sue somebody. Don't worry about any kind of personal responsibility, it's not your fault.

Wouldn't be the tartar sauce. Theirs is formulated so it needs no refrigeration and lasts a long time. Thats why they have it in little packets...

I think McDonald's should sue you for libel and loss of business....

Not to be argumentative - I am not a litigious person by nature - but if this is really food poisoning (which sounds likely), how does it relate to personal responsibility?

Tartar Sauce
* 1 cup mayonnaise
* 1 teaspoon prepared mustard
* 2 tablespoons chopped sweet pickle
* 1 tablespoon chopped drained capers
* 2 teaspoons chopped fresh parsley

Blend well; refrigerate and chill thoroughly. Makes about 1 1/4 cups of tartar sauce.


Anyway, my opinion is that the OP has very little case for a lawsuit. What his GF can do is file a complaint with the local health dept. that includes testimony from her doctor. Even a McD's will get a shakedown inspection with enough complaints -- the biggest problem is that people don't complain enough.
Also, make sure she gets tested for Hep A. It's not bad or life-threatening and, like Chicken Pox, once you get it you can never get it again, but health officials will shut down any restaurant that has a Hep A problem.

If it was truely caused by bad product, it's not related. More often than people might realize food borne illness is caused by improper handwashing by the preparer OR the diner. I.E. if she didn't wash her hands, she may have transmitted germs she picked up somewhere to her food.

To all of you people saying dont sue... Go troll another thread please because frankly i dont care. If i was her i would do everything in my power to milk mcdonalds for everything its worth.

She ate the entire sandwich so there was no way to get it tested.

I guess its common for people to get sick from fish because they cook the sandwiches ahead of time and leave them under the heatlamp for hours allowing tons of bacteria to grow.

Thanks for the comments we will just suck it up and tell everyone not to eat there (which i was already doing when the dork decided she wanted a fish sandwich).

When I worked at McDonalds in high school some asshat I worked with thought it would be funny to push me onto the grille. I ended up with third degree burn on my left arm and almost needed some nerve treatment done on it.

I didn't sue, but perhaps I could have? (hey wait...wonder if its too late :D) but really....it was stupid mistake. Just like the fish, who cares, get over it :p

Furthermore, you can't prove that McDonald's caused her illness so you don't stand a god damn chance unless others get ill or you can prove it.

Sorry, I was generalizing about lawsuits in general, and didn't make that clear.

Oh and yes, never eat the fish there. Managers like the waste product quota to be "low". It looks good on them. So they in turn get angry at the kids who cook stuff and follow the rules that you should keep such and such amount of stock. End result? I've seen people leave fish in the heat cabinet for like 6 hours and then serve it heh.
