GF got food poisoning from a McDonalds fish sandwich, lawsuit?

She has been puking her guts out and drinking nothing but water for 2 days now...

We got some meds and shes sleeping now.

She has every symptom on the list for food poisoning, and she ate a mcdonalds fish sandwich roughly 7 hours from becoming ill. I had food from another place because i despise McDonalds.

Long story short... This McDonalds sucks, bad. They have unusually low health scores on their inspections, they hire mentally handicapped people from the barber center and have them cooking food (is that even legal?). My uncle is mentally handicapped and lives with me, so please dont tell me im being heartless or whatever.

Moving on: Can we sue for the price of her treatment? Furthermore, can we sue them for a lot more based on the seriousness of food poisoning (you can be hospitalized if you get dehydrated enough).

You can't prove that she got it from McDonald's. Food posioning has an onset time of anywhere from 15 minutes to several days.

You can sue for pretty much anything.....the question is will you win.

That lady sued over the coffee spill, I'm sure you could sue over food poisoning.

most food poisoning takes a lot longer than 7 hours to kick in. And if you think that place is so bad, don't eat there. Lastly, wuit being a sue-happy asshat and stop helping contribute to the country's crybaby mentality.

I would say it was from the mayo if anything. You would have to act quick though. The doctors could prbably determine what type of bacteria caused the sickness. If the same bacteria was found in the mayo at mcdonalds for example, you may be able to prove it. But you would think that there would be more than just one case of food poisoning.

I would NEVER eat a fish sandwich from McDonalds (I hardly ever eat anything from there anyway), but it's the food item that they get the most complaints about (causing illness).

Reminds me of my freshman year at GA Tech. It was the afternoon before my dreaded CHEM 1102 final. I had gotten a BigMac on my way to the library to study. A few hours later, I got the chills with the urge to vomit. Not long after, I was back in the dorm, suffering from the common symptoms of a stomach virus. Needless to say, I didn't study much. Woke up the next day after sleeping all night, took the final (even had to go the bathroom once to vomit some more), and after the final, walked across the street to the old Wellness Center. Come to find out, I was running a 102 fever all morning.

The end result of the BigMac purchase: I failed the final, got a "D" for the semester, and lost my HOPE scholarship for my sophomore year as a result. I should have at least sued McDs for the ~$4,000 difference in tuition! But who knows, if it had not been for that "D", how much higher would my final GA Tech GPA been? Will I forever suffer because my resume states that I had a 3.2 GPA at Tech instead of say a 3.4 without the BigMac?

McDs ows me a lot I think! :D

Fast food places don't give a fvck if the meat they bring in is contaminated. I don't know if that's the case with fish but it sure is with beef.

Also, I'm not sure just how likely it is that fish would cause the food poisoning. Isn't that rare?

Then again, since it is McDonalds, one might question whether it really is fish... :confused::)

I would think she probably would be able to get a plaintiff's attorney to take the case, due to McDonald's deep pockets. My guess is that they would settle it out of court for a significant amount, so issues related to clear proof may not be absolutely necessary.

I find it interesting that so many people are pooh-poohing this potential suit (no pun intended!), yet the posters here have overwhelmingly encouraged much stupider lawsuits (in particular, in this thread).
