Getting threatened because I banned some moron from my site...

It's entertaining to me anyways...

I run MazdaWorld.org, an automotive site geared to Mazdas... nothing special, just run it for fun. I banned a rowdy member on my forums and now he's "out to get me", saying how he's gonna get me in legal trouble, blah blah blah.

Here are the emails he sent:
I see you still have not reinstated my account, interesting how you won't
answer emails from anyone, I see you even assigned an 80% warning level to
some middle aged whore for posting a single smilie, and handed out 1 week
suspensions to to others, even jk who left due to post whoring, but came
back because he missed me, yeah, great management. Nobody wants to be around
the site, mods are leaving or are fed up with you, and the only suggestions
are from fruity ass highschoolers with 929 beaters who want to give out
fairy dust for posts, and then theres duncan who every few months decides
"hey, I really should really see if MW is still around". While I know for a
fact you are not aware of my actions online and offline over the past week,
this can only end badly. Posting may be posting, but business is business,
and no one does either better then me. In the coming months you will learn
of all I have done in the past few days, some just a kick in the nuts to
you, and others which could cause legal problems for both you and MW. I made
MW what it is, and frankly, it was never your site, it belongs to the people
who post and make it what it is, regardless of what it becomes. You spend
more time on ****ty ass audi forums and invision noob topics then you do
your own forum. It would be funny if it weren't so pathetic, oh what the
hell ill laugh anyway BAH HAHAHAHAHA
The very idea that you think I do not lurk as a shadow within a shadow on
the forums behind ghost ip's, and post is laughable at best, funny how so
many members and even mods are fed up and leaving. When you finally stumble
upon what has been happening the past couple weeks, I'll laugh for you to
try and take action because your so pissed and think you can do something,
and then i'll laugh harder when a judge throws you out of court and your
forced to pay me royalitys

Anyways.. Here's what he is doing, because some members were kind enough to figure it out and tell me.

He opened another domain, "MazdaWorld.net" in order to compete with me. Fine, I really don't care about that. Then, he is copying the threads almost in entirety and reposting them to his website as if he is the source of them. Looking at his domain registration date, it's April 9, 2006.. a few days after I banned him. My site has been registered for a good while longer than that. Anyhoo.. He damn near stole my logo and recreated it. I guess his goal is to make it seem like I ripped information off of HIM, then take me to court. While I think it's laughable, just curious if I should be laughing or taking it seriously? The kid has problems, and he's going very far in venting it out but either way... I'd rather stop problems early on instead of letting them drag out.

Thanks a lot for any advice. Please take a look at the site(s) and tell me if I'm just acting crazy about my logo

The logos don't really look the same. I would document the emails and the threads that he copies and if he gets too out of hand get a cease and desist. Or if you are really feeling devilish, you could try out that new Cyberstalking law. I hear it carries a 2 year jail penalty.

Contact his hosting provider and they should take the site down. Then call his parents.

Yeah the guy sounds kinda crazy. Who would spend that much time building a replica of the original site just because they were banned? For now I would just document all communications with him and store them in a safe place, just in case he isn't a 12 year old who lives in his parents basement...

I spent money getting a professional designer to redo the site... I have like zero artistic ability :)

Looks like what he's claiming is that he created a company called Mazdaworld LLC...he could take you to court over the fact that he owns a company name, and you simply have a website, and try to take the domain from you, but I very much doubt it'd happen.

BTW his site sucks really hard, I'm talking really, REALLY hard.

He can try.. it's a personal site that is for fun and I think given the domain registration dates, it's almost entertaining.

Maybe you were too harsh as a mod. I don't know about the situation so I can't really comment I guess.
I know several CS:S servers where the mods are childish and do whatever they want.

I gave him about 25 chances in 3 years. I met him in person at a 'meet' organized by site members, and he was okay... a bit strange but whatever. Ah well, guess you don't know people :)

While your site (.org version) is graphically more advanced and certainly more active. His site (.net version) is more interactive and based on daily posts and topics, far more active for the time being. The good news is he is probably no threat to your site unless he knows alot about hacking. The bad news is that you really can't go after him for anything, all the posts I previewed (about 4) had a bolded text at the top saying "originally posted by (member name " and that information is of course visable to the public. The really bad news is that if what he is claiming is true (and please bear in mind this depends on the state and or country) he could in theory go after you, provided your site actually earned money from anything. Try to look at it like this. You own a www.starbucksforum.com, you may be a site just for fun and games that was formed 10 years ago, however the starbucks corporation could come in and claim you were using there name for malious or profitable use, and get you shut down, and/or demand a percent of all earnings. IMO they both look like great sites, both have there ups and there downs, but frankly, you should have known better then not registoring other domains that were clearly almost identical.

That really didn't make sense, and where it did, I highly disagree.
