Here, if you work a standard 40 hour work week, you are entitled to an 8.5 hr day where you get a 30 minute paid lunch and two 15 minute unpaid breaks.

So 8.5 hrs of time, 7.5 hrs of work, 8 hrs of pay. People usually play with the allotments such that they work 9 to 5 with a paid lunch and then take their unpaid breaks at the end of the day and go home. Of course the exact rules vary but I know this is the case for a lot of places here.

In the example stated in the other thread, the dude was in work during lunch and customers occasionally came in - serving them = work = pay (and being expected to answer any queries during lunch = work = pay).

Many employers have a 37.5h work week. 8.5 hours with 1 hour lunch break = 7.5h a day.

I'm salaried. my lunch break is included as a part of my 10-hour shift. it's also an unspoken rule that just about everyone eats at their desk the majority of the time.

I used to have that. I was salaried, and they did not want to pay overtime. I rarely took an hour for lunch, so I think they got a good deal out of it. When I'm working, I just like to get stuff done and spending an hour away just gets me off track. It helped when I needed it such as going to a nice place for lunch sometimes.

I'm exempt and I have unpaid lunch. Supposedly it is state law about a 6+ hr workday requires at least a 30 minute break (whether you eat during it or not).

To me it doesn't matter much because if i eat a late breakfast, I won't eat lunch, and then I'll leave to get dinner or go to the cafeteria later. So if I'm not working I don't charge my time and I just have to work later to make it up.

edit: So a regular day is 9 hours I need to be there a minimum of 9.5 hours.

I come in any time between 7:45 and 9am, and leave any time between 4pm and 5:30pm, depending on what I'm doing. I also take anywhere from a 5 minute lunch to a 1.5hr lunch. I get paid the same no matter what, no one is clock watching me or says shit about when i get there, leave for lunch, come back from lunch, or go home. So long as the work is done! Then again, work did just send me to Guadalajara where we worked ~18 hour days 6 days in a row, no bonus in pay, just a comped day off of our choosing, and not one person complained.

I really feel sorry for you clock watching folks :(

Meals and breaks are regulated at a state level. However, non-exempt employees must be paid for all hours worked, and so, if they are at their work station(even if they are eating their lunch) during their lunch time, they are required to be paid for that time.

Non-exempt v. Exempt related to the FLSA. Non-exempt means the regulations of the FLSA apply to you. Exempt means they do not (though certain regulations still do to make it complicated). A common misconception is that salaried equals exempt, and hourly equals non-exempt.

Working out of the union hall, shift work always included paid lunch breaks.
Day shift= 8 work hours + 30 minute lunch break = 8 paid hrs.
Swing shift = 7.5 work hours + 30 minute lunch break = 8 paid hrs.
Graveyard = 7.0 work hours + 30 minute lunch breal = 8 paid hrs.

I work graveyard and for me it's LOJ (Lunch On the Job) basically eat when you get a chance at your desk, and 2 15 min breaks. and it's a strait 8 hrs, 10pm - 6am for me and 12am - 8am for others on my crew.

Same thing here except 10 minute paid breaks. Mandated by government, although most employers give 15 minute paid breaks and many give 1hr unpaid lunch.

I'm on salary and I do 7:30 or 9 till 5 or whenever I need to finish, if thats 6 or 7 thats that. If I have enough cover I go out for an hour lunch at the gym, if not I get a working lunch.

I work 8-5.

M-F 8am-4pm = 40 hrs

45 minute lunch not paid

= 36.25 hrs per week
