As it turns out, I am in my last 30 days of service. My contract ends October.

According to the last 2 Sprint reps I called, both said there is no ETF when you are within 30 days of your contract end date. Can anyone confirm on deny this? The lady said she will note it in my account and gave me the interaction ID for the call.

I was a little confused because the Sprint site http://shop2.sprint.com/en/services/termination_fee/early_termination_fee.shtml
Says 23 months has a $50 fee. Unless they mean less than 1 month is no fee?

Other that that, I was calling about the admin fee change and the lady knew about it and said it is possible to cancel without ETF due to it, but then said I have no ETF because I am in the last 30 days of my contract.

Guess you shouldn't have procrastinated again and gotten out of contract as soon as you could :awe:

Ha, true, true. Though with a dead phone I can't really call to cancel :p Oh, well. Even though I'm now living within the TMobile prepaid envelope and certainly enjoying the ~$7/mo average that I'm paying, it's getting rough at times. People keep sending me texts or forgetting to text my GVoice number, so that really eats into my dollars. It's really bad when my coworkers text, as they like to do mass texts and mass reply alls. Not fun when I get 10-15 texts that have nothing to do with me, but they're all MMS so I get charged like 15-25c per.

TMobile has good coverage here, though they were the only company to lose signal when the hurricane came through. Thankfully the Wifi calling worked fine. Once you go outside the city limits it's pretty much a giant dead zone for Tmo. Not having data has been a bit of a pain at times, but I don't want to necessarily spend $1.50 just to check my email or something.

I also don't really like this Optimus phone, even though it took weeks to get working semi-reliably. It seems like every time I use an Android phone, something is always wonky with it. I think I have an anti-Android aura. Android phones always seem to crash or not perform correctly when I really need them too, but work fine just sitting around at home. Not dissing the platform or anything -- I just have bad luck or an unconscious PEBKAC issue.

Now that it's a rare crapshoot as to if you're going to get a rep that'll let you out of the ETF and the reports of an October iPhone release are increasing, I might just hold on for another month and see what happens. I'm also going to be traveling a bit in the coming months, so if I still have Sprint the unlimited data and calling will come in handy.

So that rep called me back and she's pretty nice but keeps telling me that legal department will not let anyone out of ETF for the admin increase now. She told me that I can either take the $50 credit to my account or give back my Epic 4G for $110 (my etf is $110) and close my account. Its not really a "deal" but Im considering it. Its not really worth me paying $70 a month for service that sucks for another year when I can use my friend's old Nexus One for a few months on Tmobile's month to month until the prime comes out...

Opinions?

Evidently Sprint's thinking that are able to play with the big boys back-fired, big time. I guess a lot more decided to cancel than what they thought.

There are other material changes but they won't let you out. They chnaged arbitration procedures and add a phrase they can at any time change discounts and technology clauses in the contract now at any time. These are material changes but they won't budge.

I smell a class action for these other changes. Oh and that's now against their new contracts... you can't file class action.

It sucks everyone else is such a rip off. I still think I am going to just pay for the epic touch outright.

I saw that too. Basically Sprints contracts now state that they can change about whatever they want whenever they want and all you can do is take it to an arbitrator with a history of siding with corporations. They will be out of business in a couple years at the rate they are going. Poor coverage, horrible data speeds, a complete cluster of 4G strategy, and horrible customer service. Unlimited data and the iPhone isn't going to make up for that.

I was already part of one Sprint's class action against ETF violations. After years it boiled down to something like $39 or a month of free service. This is before the one that's forming about the Evo/premium data fees that was filed back in October.

Yeah the downside now is with the recent SCOTUS rulling /w AT&T these can't go class action anymore due to the arbitration clause, which Sprint is claiming isn't a material change.

I need to be sure to get a free Airave out of this at least. I also wonder if sprint will have any kind of deal for current customers to get an iPhone at a reasonable price.

I'm sure they will, $199 when your up for upgrade. If you think they are going to do early upgrades your kidding yourself.

I think I'm either going to stick with Sprint "for the duration" or just go to Verizon on my girlfriend's plan. I really like the flexibility and the cash I'm saving with TMobile's prepaid, but I'm having a good bit of service problems or quirks. My phone has also been a thorn in my side, but I dunno if I wanna plunk down several hundred for a sorta high end to high end phone.

Well I couldn't get out of the contract but I got my wanted end result anyways... Got upgrades on both lines 13 months early.

Your agreement with us, which started on 10/04/10, will be completed on 10/03/12.

Care to give some specifics on how this conversation went?

I just kept escalating. Finally I got to one girl who was crazy nice and kept apologizing because she wasn't allowed to help me and because no one had called me back previous times. She had to escalate me again and gave me her direct number and promised someone would call me back. This time someone finally did. This guy said legal wouldn't allow it but why did I want to cancel so I explained about some phone issues and he asked if I would accept new phones to settle the matter.

Whoever called me was high enough up to have a assistant. He was very nice also and kind of just chatted with me for a while.

Guess this means there is an opportunity to get an early upgrade for the iPhone after all (as mentioned a couple of posts earlier).

Do you remember which line you called in order to get this?

I started all the way at *2 and escalated probably 6 times if not more. I couldn't tell you which department I ended at but he had an assistant so I am guessing pretty high up.
