Get out of your Cingular Contract w/o ETF

if you get out of the contract, can you still stay with them on a non-contract basis? can you then renew your contract for another 2 years (ie. new phone)? what happens to your number?

I don't believe you can sign a new contract within 6 months with the same company, as this would be considered a type of fraud commonly called "churn."
 
Considered fraud? Because it doesn't explicitly benefit the cell companies? That's an unnecessarily aggressive stance to take. Utilizing THEIR contracts termination clause, then signing another one of THEIR contracts somehow constitutes fraud?

And 'churn' is not a form of fraud, its an industry term for the percentage of customers who switch carriers! So, if you're an account manager at some cell company, churn is a four letter word, but not illegal by any means.
 
has anyone else done this? I just dropped my text messaging plan and gonna call them in a few days explaining how I just found out of the rate increase and that I can't afford it.

Just do it now and don't take no for an answer. Speak to a supervisor if you have to.
 
On the service terms it says you can terminate within 30 days after the first bill reflecting the change. So for me i have to wait a month to do this, after the next bill.

I just called and got completly no where with it. he says that since text messaging is a free service until you use it. it does not fall within the contract of being able to terminate early" She was very polite, and put me onlhold and talked with a manager about Page 6 on the service agreenment that was shown above. And she came back and stated the above, that since a service that is changing that is free to cutomers it does not apply. I told her it's free until I use it...then you chjarge me and it becomes a service and I am paying for it. She dissagreed....I don't swee how they can lie threw there teeth.

So imoral....Ohh and another thing...i told her I had AT&T for 12 years before Cingular bought them out...and I never had a problem...and she goes...well do you ever think why they went under...they gave away things for free.....I said WOW......that's just proves the level of imoral buisness they practice.

text messaging is .10 until after the end of january. I interpret it as you can be terminated after the first bill that it has changed. Not after the bill that announces the change thats coming in a month.
 
If you dont succeed the first time, just call back. Same deal with any retention deal, etc with cell phones, cable, satellite, etc. Always get different answers depending on who you talk to.
 
UPdate...I called back and asked for a copy of my ORIGINAL SERVICE CONTRACT and the lady put me on hold for what seemed a long time and then came back saying she cannot find it, and asked if she can call me back when she finds it. I told her if I cannot see in front of me the contract saying that I am in this for 2 years and ending on such and such a date...then I am not in one....she abruptly put me on hold. Haha...in the meantime I filed a claim with BBB.com

We'll see. But I think I'm getting ahead now....

Wow, that and 'it's optional to use' excuse is so BS! For all they know, you could of signed up in the past with every intention of 'just' using text messaging 100% of the time @ the pre-set rate. What would they say then?

They changed the terms of agreement, at the very least they should abide by their own terms and honor any request invalidate your contract, skankers.

Ask her what you're supposed to do when you receive an incoming text message that you can't disable. I think that qualifies as subscribing to a service.
 
UPDATE - I AM OFFICIALLY OUT OF MY CONTRACT.
She called back and said "Sir I cannot furnish your contract at this time" I said "Ok I would like to formally express right now that I would like to be released from my contract due to Cingular not being able to show me my current contract". She said Hold.....2 minutes later....came back and said "Ok Sir both your phones lines are officially released, and will not be charged ETF, would you like for me to cancel your service today?" I said no, I just want to be realsed from my contract at this point. She said your phone #'s will be available to port if you'd like. And she will notate the account of this fully. I said thanks for your time. And that was that.

From cingulars internal memo regarding the price change.

Q. Will this price increase allow customers to end their contract without paying an Early Termination Fee?
A. No, this price increase is not considered a change in the terms of service and does NOT qualify customers to terminate their contracts without paying the appropriate fees.


If you get a rep that lets you out, consider yourself lucky.
 
Ask them that you want to see a copy of your contact in paper in your hand....mosy likely they will not be able to furnish it....and then you have the right to get out....since then there is no contract and will not hold up legally whatsoever...that's what I just did. And got out....

Just need to find another good plan

Right now I am paying about 120 a month for 4 lines 1400 anytime 2 lines have 1000 txt
