Jim Baker came out angry that it isn't fair that the democrats are changing the rule after the game was played . They say they will examine all there options to try to reverse this injustice.


I hope Bush goes down fighting and not wimp out. If the democrats are going to play dirty than the republicans need to play dirty to.
 
Won't be Bush that overturns the 6 democrats and 1 indy, it will be the Florida Legislature, the people that make the laws. The leaders of the state legislature are going to call for an emergancy session. They have the power to override the court, and seat a Bush electoral vote.
 
This would be a truly extreme measure. I hope people understand that this would be far, far beyond anything Gore has done to challenge the election in terms of its use of the blunt instruments of the law. If it takes action that drastic to seat a president, God help America, regardless of the outcome.
 
Well if the state legislature feels the Florida Supreme Court over stepped their bounds, which I agree they did, so do lots of people, they have every legal right to do what they are planning on doing. Its just the same thing, the US Congress can override the electoral college vote with a simple majority in the house and senate. Its in the constitution.
 
jacobnero6918 -- You obviously didn't listen to the actual court session or even the actual text of the announcement. If you had, you'd know that they grilled both sides quite hard, and their decision was well considered. I haven't had time to read all of it, yet, but their over-riding concern was to give every opportunity to every voter to have their vote counted. They put a time limit on it to avoid running out of time and having Florida lose their electoral voice.

BTW -- Isn't Georgie the one who said he wouldn't drag this into the courts, in the first place and then was the first to sue? Credibility? NOT!

Reconciling facially inconsistent laws is part of the role of the courts, particularly courts of last resort (i.e., the US Supreme Court and its state analogues). In this case the laws could not realistically be applied simultaneously, as the provision allowing manual recounts made it logistically impossible for a larger county to submit certified ballots within seven days.

That is why the scorched earth plan of GW will fail miserably,not only on its merits in a court of law,but in the court of public opinion. I don't think the party loyalists have the stomach for a fight as drastic as using the partison legislature to attempt to overthrow a Supreme court.

I have not heard a single news caster talking head ratchet up that kind of dialog yet tonight. Only that Baker is studying his options. He should be stidying for a new job. He has failed GW miserably.
 
Tee_Edwards - Many people feel that the statutes were not in conflict and that the Court overstepped there authority to rewrite the laws (extend the deadlines) as they wished. Others feel that the Court was fine. I've heard some argue that the legislature has the power to decide that the Court errored.

As I posted in another thread, I think the house members will be taking a big political risk to overturn a vote. I doubt that they have the intestinal fortitude to do so.

Actually a CNN correspondent did say the Florida Legislature was strongly for a emergancy session to discuss the Supreme court matters.

If memory serves me, I think Russ is right. I recall Gore filing something early one, then withdrawing it. I'm not sure he ever refiled though.
 
Read the fine print. Gore does not have his fingerprints anywhere on that suit. It was a citizens suit over the buchanan vote problem. It was filed before the Gore team arrived in Florida.
