Gardening nudists claim discrimination

BOULDER, Colo. - A couple of nudists claim their landlord is wrongly discriminating by trying to get them to cover up while gardening. Robert and Catharine Pierce have been accused by their landlord of being a nuisance by gardening wearing only thong underwear, plus pasties for Catharine Pierce. Neighbors complained to police about the Pierces' scanty clothing. But police say the Pierces are not violating the law as long as their genitals are covered.

But their landlord, Boulder Housing Partners, has sent the Pierces a letter saying they could face eviction if they don't cover up. The Pierces say the threat of eviction amounts to discrimination.

"We want our freedom," said Robert Pierce, 58. "We want exactly what the law gives you, and we don't want to be harassed about it."

Defining nuisance difficult
Betsy Martens, executive director of the Boulder Housing Partners, which administers Boulder's affordable housing program, told the Daily Camera newspaper that defining the word nuisance is difficult.

"This is not a legal issue, it's a community issue," Martens said. "We try and balance the needs of the whole community."

Neighbor Emily Hink said she spied Catharine Pierce, 51, gardening as she was driving home with her daughter, whose "jaw dropped."

Hink said she's not opposed to people being nude in their houses ? or even in a fenced-off back yard ? but the Pierces' home is on a corner just a couple of blocks from a school.

"There are so many parks around here, and there are lots of kids around," Hink said. "They're on the corner lot right across the street from the community gardens and the Waldorf school. The whole street is lined with kids."

Ultimately, if the Pierces continue their near-naked gardening, Boulder Housing Partners can choose to evict them. If the couple fought the eviction, the municipal court would be left to decide whether their behavior constitutes a nuisance.

Personally I would have a problem with it. This is not acceptable in our society. If they want to run around naked, they should find a private place to do it.
 
For better or worse, nudism simply isn't a part of mainstream American culture, and I don't really see the benefit in going through all the effort to change that. I wouldn't blink twice if I saw it in Europe or some other place where it's more common, but it's just not how we roll.
 
They weren't even nude... oh and gross but they should be able to do that if they want to, just think of the potential if some 20 somethings did that. :Q

But seriously, if they were just gardening so what. People should have the right to dress however they want to.
 
so, she's not really nude, is wearing more than in a non-nude strip club and what would probably pass at most beaches.

I have no problem with what they're doing. From what I can tell, they are not trying to make themselves into spectacles, i.e. people aren't forced to look at them.

What if I was offended? What follows from that? That I'd have a right to put an end to their behavior? Lots of things can be offensive and legally protected.

I can simultaneously be offended while thinking public nudity should be legal. I think the KKK marching through a black neighborhood would be offensive, but legal.

My answer is no, I wouldn't be offended, though yes, if they are old and wrinkly it'd be kinda gross, but whatever.
 
I happen to like clothing. There are nudist places for people who don't, they're free to go there. Otherwise they need to abide by local standards.

What about the children? Children are people and they see themselves naked all the time.
 
While they are likely within the letter of the law as far as wearing clothing, they do appear to be causing a disturbance. While I do think that the "OMG think of the children!!1" crowd should be lined up and shot, I also think that really bad taste should be a crime.
 
Meh, it's not discrimination if it's a nuisance.

Personally, while I'm not offended, I think it's incredibly poor taste. If the community/courts determine it's a nuisance, landlord gets to evict. Tough shit.

I watched Taken with my wife the other night, then told her to guess what it was rated. She said 7. I said no, the MPAA rating. She said R. She was surprised that it was PG-13. Apparently all that violence is fine, but if you say "fuck" twice, or show nudity in a sexual context you get an R. :laugh: You can have nudity without sex (see: Titanic) or sex without nudity (see: any number of disappointing movies 😛 ) and get a PG-13 rating, but show too much of either or show both together and you get an R.
 
Of course it's in Boulder... shit like this doesn't happen in normal places. God damn hippies are fucking everything up
