GAH.. accident/insurance issues.. should I call a lawyer???

Okay.. long story short, I am qouting Nutdotnet

One-way parking lane in a parking lot (the lanes probably alternate as to which direction they go). She passes you driving the correct direction. She proceeds to stop and begin backing up. Meaning she is not only is she going down a one-way lane in the opposite direction she is also driving in reverse. You, assuming that no one will be coming down the lane the wrong way, start backing up. BAM! She hits you.

She is clearly at fault. While I myself look both ways many, many, many times before backing out of a parking stall (one-way lane or not) the lanes are made one way for a reason.

She will be covered under her boyfriend's insurance policy. As long as he gave her permission to drive it she is covered.

Now. The side of my car is damaged, and the right corner of her rear bumper is damaged (she back into me at a sort of angle.. as I was backing out of an angled space..) She has CHANGED her story, saying I backed into HER (WTF.. the SIDE of my car is damaged.) the police report comes out on monday. Her insurance company told me that I "better go ahead and call my insurance company, because this is probably going to end up being a 50/50 thing where my insurance pays half. " I was what the hell do you mean?? she hit me?!?!! They responded with "well.. it will take 3-4 weeks for a full out investigation to go through.

My question is this : The police report comes out tommorow. If in it, she is clearly at fault, what do I do? Wait for the investigation to finish (my car is NASTY BROKEN looking.. I DONT want to wait that long to get it fixed!!), call my insurance (probably raising my rates), or call a lawyer??

cliff notes:
I got hit. The lady is now saying it's not her fault, her insurance is giving me the run around.. wanting it to be 50/50 between her and I, and a 3-4 week wait to get my car fixed if I argue with that.

I would say call a lawyer. How could you have backed out on her? The damage clearly shows the opposite.

I was involved in a similar situation and it was called imprper backing.

hrm... it was on private propery.. and she was backing down the wrong way.

I'm not sure. I think what im going to do is fax them the police report. I was halfway backed out, then she stopped, and backed up into me.. I dont think it would have been possible for me to avoid it.

I would still think that what she did is improper backing. I mean you are not supposed to drive in reverse. In my instance I was backing up because I had missed a turn and a lady hit the rear of my truck, insurance paid for her damage. I got out of the ticket, because she was doing a u-turn and the judge said she should have made sure it was clear before she proceeded even though i was backing up, down a one way street. The judge told me I shouda went around the block.
