As for going off uninsured motorists coverage... are you nuts???? First off, there's this thing we people in the real world like to call a deductable. Which means, a little bit of money comes out of my pocket first before it ever comes from the insurance. Mine's not high at $200 but the difference off a $200 deductable for me and a zero deductable on my car is a difference of paying $580 every six months or paying $840. So yah. Going from $200 to $500 deductable was a difference of $570 to $580 or somethng like that hence why I still have. Furthermore, if I make a claim on my insurance that is a ding on my insurance and my rates go up. If I go after the guy because, and I know this might be a hard concept but follow along with your best, it was HIS FAULT then I don't pay crap out of pocket or get dinged on my insurance rates.

Sorry, still pissed, a little sleep hasn't cured that.

move to california, there are just as many beautiful strippers out here. They may be made out of more plastic, but why does that matter? Oh, another reason to move out is that the insurance company isn't allowed to raise your rates if you aren't at fault in the accident.

Did you ever consider that the guy who hit you probably can't afford insurance and so he probably doesn't have $1,500 lying around to fix your car?

Good luck getting the money out of him, though.

WTF. you can't drive a car here in Canada without insurance... so are these people driving illegally or is insurance actually not mandatory? man that would be dumb.

When you get rear ended, your arms naturally stiffen on the wheel, which in turn causes your shoulders and neck to push forward (which they weren't designed to do), and viola! You have whiplash.

You're most likely going to get very stiff around the lower neck/shoulder area for the next week or so. You should be able to control this with over the counter Motrin. Go to the ER if you have problems breathing, dizziness, or blurred vision.

No, it's mandatory here. Just people have the "If I don't get caught how are they going to know?" menality a lot of times.

It's mandatory in Texas to have insurance. It's the law and if you drive without it then you ARE handcuffed and sent to the jail. Can't remember if it's considered a felony offense or a higher class misdemeanor but it is required. Problem is, we get so many worthless people coming from across the border and they don't have any insurance to speak of.

Yah, my neck, and shoulders, and upper back though are pretty stiff and sore and have been hurting worse as the day has worn on.

Okay, well, I woke up, neck and upper back between my shoulders is a bit stiff but I don't think it's anything major. I got a nice imprint of his license plate on my rear bumper. You can see like 3 of the letters very clearly as they cracked the vinyl there. If you were walking by and not looking, you wouldn't notice with a cursory glance.

Its cool, I'd completely understand if that was my new car that just got hit. BUT, depending on what kind of coverage you have, most of the time they will WAIVE your deductible if its an uninsured motorist.

After that, they will send it to their inhouse legal department which will probably then outsource it to an attorney local to you, or where it happened and then they will sue that guy. I used to work at an office that handled that a lot for Allied/Nationwide/such and such insurance company.

I honestly say good luck, since a lot of times we'll get the insurance company to "settle" for the other party doing a payment plan to pay them back, which includes any other damage that you have incurred, including rental costs that the insurance company didn't pay for and all that. Whats really common though, is we'll spend maybe 2-3 hours on it and send it back to the insurance company going you know what, good luck finding this guy. We recommend you just eat your loses and close the case cuzz its damn hard to pinpoint a specific Jesus Hernandez in California unless they're a normal citizen and you got their REAL social and all that, which means they'd probably have had insurance anyway.

That also means you're probably screwed in getting him to pay for your car and are going to have to go through uninsured. Although he might be scared and try to pay you for it so he doesn't get deported or whatever.
