KENNEWICK, Wash. ? A man who reportedly told police he was trying to deter a friend from driving drunk by blasting the friend's windshield with paintballs wound up in jail. In the words of Kennewick, Wash., police Sgt. Ken Lattin: "This is a very creative way to prevent someone from drinking and driving, but not legal or safe."

Responding Tuesday night to a nearby resident's report of a man shooting paintballs at a car, police found the 41-year-old man, who explained his rationale.

The Tri-City Herald reported the man was arrested and booked into the Benton County jail for investigation of unlawfully discharging a weapon and an unrelated misdemeanor warrant.

Lattin suggested a designated driver would be a better approach.

"better" approach? sure.....more fun?....probably not.

not if the police are charging him with unlawful discharge of a firearm. he also had a warrant.

I'm no lawyer, but this seems akin to two people playfighting, and then they get charged with assault and battery. If it's all good fun and no one feels like a victim, why the charge?
It would seem like it'd be up to the drunken friend to push charges.

Wow that's pretty sad. Is a paintball gun even considered a firearm? Yes they can hurt but damn... pretty sad to go to jail or/and get charged for use of weapon when it's a paint ball gun. And it's not like he was shooting people with it.

At most, I could see vandalism, but discharge of firearm? wow.
 
How can that be a firearm? Isn't the definition of a firearm something that uses explosive power to propel a projectile? It has probably been considered a deadly weapon, but not a firearm, it uses compressed gas.

Should have put a boot on one of the tires, that would have kept him from driving. (or easier things like removing the battery, disconnecting some key wires, etc.)
