He was given permission to have the tape with certain contractual conditions.

Theft would have been if he'd just taken the tape from the shop without permission.

The old ones would have a clause that say you will be charged with theft if not returned within 72hrs. Blockbustemers changed that to you bought it after 72hrs or what lever the time frame was.
