You basically have this entire thing backwards, this is not creating new law, it is simply affirming that you do not have a positive right to attack police during a search if it is in fact unlawful.

I believe you do have a right to defend your home against illegal searches, it's in the 4th.

IMO, you're basically saying that we don't have the 4th, instead we have a right to sue police for illegal searches as long as we don't resist. And we discuss lawsuits here in a manner that is far too casual. We pretend that they are easy and simple when they are nothing of the sort. In most cases you're going to have to come up with $10-20K out-of-pocket for a retainer to even start one and then spend loads time away from work that you cannot by law be compensated for.
