Ford dealer auto tech tears customers car up, customer has dash camera... :)

So they knew the camera was there but chose to hoon around in it anyway? What a couple of dummies. This is why I really don't like leaving my car alone with anybody.

I am guessing they did not know that it was on and also recorded sound.

Seems the driver went to the police after the report was filed and a cop basically laughed it off.


This dealer went from man one of our people messed up to... lets really f__k this up and make it 10 times worse.
 
This is going to get really bad for them once it hits Jalopnik. I'm guessing the 40 Google reviews are going to soon shoot up into the hundreds in a few days.
 
LOL, the dealership, Sawgrass Ford in Sunrise FL, filed a police report because the victim posted the video on Youtube.

However I have a very difficult time imagining that a district attorney or city attorney would have any interest in pursuing charges.

This is not going to end well for the dealership.

Sad case. I hope the owner gets a new car. Really makes you think twice when you drop the car at the dealer. Frankly, speaking I think the Police should be filing charges. This case smells pretty bad and I really don't understand what the dealer is thinking dragging their feet on this forcing the owner to escalate to Ford.

It is yes, but it's really "two-party" when there is a reasonable expectation of privacy. If I record you taking a shower through your window, yea no dice. If I record you walking down main street, well you're in public so there isn't really a reasonable expectation of privacy.

I'm not too certain how a dash cam on a public road plays out, it could go either way IMO, but then again they acknowledged the cameras and continued on anyway.
 
If you want to feel bad for humanity, go read the YouTube comments. Although that is true for pretty much everything on YouTube.

Strictly speaking, the text of the FL statute makes absolutely no mention whatsoever of any expectation of privacy, reasonable or otherwise.

That said, it seems very likely that caselaw has inferred the requirement of such an expectation since otherwise people taking home video on public beaches could be charged under the strict text of the law.

However, the inside of a vehicle with the windows up absolutely would give rise to the reasonable expectation that one's vocal statements were private. And acknowledgement of the camera is not acknowledgement of voice recording. Even if they saw the camera and knew it was recording video, that doesn't mean they also knew it was recording audio and it's audio, not video, that runs into the problems with the wiretap law.

See my comments above about the difference between video and audio recording. Just because they knew or suspected that it was capturing video does not necessarily mean that they knew it was recording audio and it's audio, not video, that is restricted by the law.

As I said, I don't believe any DA would bother with this case. It would be horrible publicity for the city. But just because a DA uses his or her discretion to choose not to prosecute doesn't mean the actions giving rise to the complaint are, strictly speaking, clearly legal. It just means that taking things to court isn't worth the hassle.

On the other hand, the unauthorized audio recording of another party does give rise to potential civil liability as well, so the dealership could bring a civil suit even though the DA declines to pursue criminal charges. However, I would imagine that any decent attorney would caution the dealership that the negative publicity from such a suit would vastly outweigh even a best-case-scenario damages recovery by the dealership.

Sawgrass Ford takes its customer service reputation very seriously. Although the customer's vehicle was fixed by driving at a high RPM, our dealership does not condone the language or the specific method used to solve the issue. I shook the customers hand and thanked him for bringing this to my attention. The technicians involved were dealt with, and the customer asked for some unrelated goodwill. We gave him four wheels and tires, free flushes and services, he took down the video, and we considered the matter closed. Neither the customer nor Ford was ever charged a dime. Commenters with technical knowledge have noted that the rev limiter on the car never went off, so the claim that we " blew up" his car was merely sensationalism, aimed at getting the video to go viral. This is a complex matter now because the surreptitious recording of individuals in the state of Florida is a crime. Sawgrass Ford has to be sensitive to the legal right of our employees as well. While we have always done everything we can to maintain happy customers, We cannot in good conscious continue letting this customer go on using the internet to gain free services from Sawgrass Ford. As always, there is more to the situation than this video shows. We hope viewers can see what is actually motivating this customer. Our intent is to put this behind us and move forward with the same customer satisfaction that has earned us multiple presidents' awards.

The technicians involved were dealt with and next time they will be sure to disable any recording devices in a customer's vehicle. The customer asked for some unrelated goodwill that would have cost use more money and we told him to go stuff it. We gave him four wheels and tires after he caught us only replacing three (PSYCH!), free flushes and services, he took down the video, and we considered the matter closed, no matter what the customer thought. Neither the customer nor Ford was ever charged a dime and the customer's time and inconvenience in this matter are things he should have come to expect from us. I think he will need to get the transmission diagnosed as having an issue at another qualified shop, just because it isn't throwing a code does not mean it didn't get damaged by the "mechanics" driving it around like that. If he can get that then he can sue the dealership over replacing the transmission.

*MOST* manual transmissions do not have codes to throw besides vss codes.
