AFAIK, most of the "threat" statutes require that the threat be made to its intended target, not to a third party.

However, there may be a more serious crime here, that of conspiracy to commit murder. He says on the tape that he has a gang of Russian thugs ready to pull the trigger on his opponent. If that is true, it's a murder conspiracy which he confessed to on tape. It probably isn't true, though. But the state only needs to show that he confessed to it. He then would have to prove he was lying.
