First Speeding Ticket

I just got my first speeding ticket the other day and I was wondering how I should go about fighting it. I know I was speeding (80ish in a 45 zone.) But I'm pretty sure the lady that pulled me over didn't radar me cause she looked off duty or maybe that's how they dress when they're in unmarked vehicles. She also said she pulled me over cause i was driving faster than her. On the ticket it said 72, which I'm guessing is her speed. There was one other guy right next to me and I was trying to pass him so I could get to the exit, plus I don't really know that area well, which are my only defenses. But they'd probably just say I should've slowed down and passed from behind. I better tell you why I was speeding so much cause I know that is going to be half of you're replies. I went to my girlfriends house, bout an hour away, and when I was trying to leave to go to work at the last minute, she made me take her to get food. So I had about 30 minutes to get to work, an hour away. I kinda forgot that I wasn't on I-95 yet so cops might actually care how fast I'm driving.
My mom said I should plead guilty and request a hearing to lower the sentence. I don't mind paying the ticket $145 isn't so bad, I just don't want them to raise my insurance, that's why I'm fighting it.

Suggestions anyone?

You can explain all of that to the judge, but you'll be found guilty. Traffic CANNOT make you speed.

80 in 45 is not really something you can talk yerself out of...

If you go see the magistrate, he might give you some break for the first offense, but you are definitely getting some points and fine for being that much over. They dont tend to symphatize with people going 30+ over..

if you ahve a clean record you might be able to get away with paying the fine without getting any points on your license

I know I know, but I need some sort of devious scheme to get away without higher insurance.

I guess i could just pray the cop doesn't show up for the trial.

I have a clean record, no tickets no warnings. but she said when she gave me the ticket its 2 points.

A junior poster asking about speeding tickets. Uh oh. Flame-city coming up.

'course, I'm in a similar position as you are. I don't mind paying my ticket, but I hate the fact that insurance companies use this as a reason to rape me some more. Not sure what I'll do yet, but I tend not to ask here on AT about it... ;)

You might be able to take a defensive driving course or deferred adjudication to avoid the insurance hit. Dunno if that is allowed in your state though. Also with the gross neglect of the speed limit (almost twice the posted limit) you might not have many options.

If you explain that it's your first offense, the judge might let you plead guilty and go to traffic school instead of putting a point on your license. But whatever you do, don't give him all those BS excuses you just posted. Just admit you were speeding, because 80 in a 45 can't be justified by "I was late for work."

Heh, interesting tidbit considering my Geico policy is up for renewal this month and I'm debating whether to stay with them.

You never know. Sometimes the overly sarcastic remarks can give you great ideas. If anyone read the post about oversleeping and missing the test, once the school year starts I'm gonna try missing a test then getting a tired changed and bring the receipt to the Prof, saying I got a flat (a test that doesn't matter much just to see if this will work.)

Your insurance is going to go up. If it had been like 55 in a 45 they might have given you 5 over which is $90 and no points (in FL at least) but 30 over you are gonna get points on your license. Also bare in mind that you are going to have to take time off of work to fight this if you decide to go that route which = more money, so you have to decide if its worth it to you.

Remember guys the cop only got me for 72, so thats only 27 over. Not that it matters too much, that was excessive even for me.

Thanks that's actually a really really good idea, I think I might try that. So it's either request a trial and pray the cop doesn't show up or request a hearing (no cop present, cause I'm pleading guilty by requesting the hearing) and hope I can go to traffic school.

Time off work doesn't matter. Since I'm part time, my job won't let me get away with taking real time off, they'll make me come in Sat or Sun and make it up. Speaking of work I better go before I'm late.

Oh and yes, I'm very whipped. But I'm not driving down there anymore. If my girlfriend wants to whip me she better come to me.
