"Fireman Ed facing charge for bumping Giants fan"

"Fireman Ed Anzalone is facing a simple assault charge following an altercation with a Giants fan during the first football game at New Meadowlands Stadium last month, NJ.com reports.
The lawyer for Giants fan Christopher Black told the website an East Rutherford judge agreed to charge Anzalone after a probable cause hearing."

Do you think this deserves an assault charge?

Uncalled for, but hardly a reason for charges. If he wasn't famous, it wouldn't happen.

Didn't look to me like it rose to the level of "assault," but IMO, the Jets fan does look like a total douchebag who wasn't about to let a fan of the opposing team get in a cheer for his team...and that opposing fan also looked like a douchebag for trying to interfere.

Why the fuck are sports fanatics so fanatical?

It's a fucking game...not a serious life-shaking event.

The Giants fan should have known better than to interfere with Fireman Ed while he was doing his thing, but that does not give Ed the right to push him. That being said, I think the lawsuit is frivolous. If Fireman Ed is found guilty I hope Woody Johnson or someone from the Jets pays whatever fines he has to pay. They should also consider having security stand by Ed to prevent other drunken fans from causing more trouble.

You never heard of fireman ed? He's been there for decades doing this stuff. Giant's fan wanted to show him he's not the only one who could lead on a crowd.

They both acted like a bunch of 10 year-old's, but the assault charge is just pure bull sh**.

Nah...not a Jets fan, nor do I generally pay much attention to the antics of the fans in the stands. The Oakland Raiders' "Black Hole" gang has taken fanaticism to a much deeper level...

assault

At Common Law, an intentional act by one person that creates an apprehension in another of an imminent harmful or offensive contact.

An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm. It is both a crime and a tort and, therefore, may result in either criminal or civil liability. Generally, the common law definition is the same in criminal and Tort Law. There is, however, an additional Criminal Law category of assault consisting of an attempted but unsuccessful Battery.

Statutory definitions of assault in the various jurisdictions throughout the United States are not substantially different from the common-law definition.

battery

At common law, an intentional unpermitted act causing harmful or offensive contact with the "person" of another.

Battery is concerned with the right to have one's body left alone by others.

Battery is both a tort and a crime. Its essential element, harmful or offensive contact, is the same in both areas of the law. The main distinction between the two categories lies in the penalty imposed. A defendant sued for a tort is civilly liable to the plaintiff for damages. The punishment for criminal battery is a fine, imprisonment, or both. Usually battery is prosecuted as a crime only in cases involving serious harm to the victim.

I just don't see how the simple "bumping" shown in the video qualifies as either assault or battery...although there MAY be more too it than we know.

I've been bumped harder walking through a crowd

That's what I was thinking. Now you're going to have people filing assault charges on random people that they accidentally brush shoulders with. IMO the judge should see the video posted in the link and throw the charge out, as the Giants fan was acting immature and stupid.

Any man who gets lightly bumped like that and calls it an assault cannot call himself a man.

What a fucking waste of everyone's time.

Really? In this day and age, they let someone stand on the edge of a wall like that? Don't their lawyers inform them, "if he falls, we're gonna get sued."

Having just sat on a jury for an assault charge, I'd acquit on this one.

In my state, assault is defined as "knowingly, intentionally, or recklessly attemps to cause bodily injury". I just don't see it there.
