Filling for Bankruptcy

Finally my mom is filling for bankruptcy and I?m happy she finally did it because the calls, the hassle she is getting its well horrible. Our Voice mail is filled to about 90% every day.

If anyone has done this, what should be expected? Her lawyer is putting in the paperwork next week to the court.

once she has a case number do not speak to any collector. just deal with them in court. I was suprised how many did not show up to court. Sears will have a resident attorny so kiss all yours sears stuff goodbye.

No sears account. But I know how bad ass they are, few years ago my mom had to file bankruptcy for her diseased dad and sears was still coming after the family.

Funny you should say that. Many years ago, my boss filed for bankruptcy and the only company that came after him was Sears. They took back his wife's engagement and wedding rings.

She had better file fot bankruptcy before king George (Prez. Bush) signs the bill that will make it much harder for average people like your mom to file for bankruptcy.

The laywer's office should handle all the paperwork. Any calls after the filing should be referred to them.

One will have to show up for the final review before the judge. Unless there are complaints by creditors, everything will be a go. Paperwork will sit in limbo for a couple of months to allow initial complaints to be filed and then the bancrupcy becomes finalized.

Kidding aside, I hope things go well for your mom. However, I can't help but wonder why everyone in your family is filing for bankruptcy and not learning?

No first time, when her dad died the collectors still came after his children so they had to file for bankruptcy under his name. my grandfather died of cancer with in 6 months so most of the money went into his health.

Not everyone, my grandfather bankruptcy was only the result of him getting sick and then dying, that was like 15 years ago.

Will the calls stop? she did tell me the lawyer is going to do some type of background check on her and stuff and will take care of everything on contacting the creditors.

Update: she just had her day in court today and the judge said everything should be ok, whatever that means, i guess that sounds like a good thing.

yah, it's a law that says if you can pay off your debt, you can't file for bankruptcy. makes sense to me.
