Federal court rules against FTC no-call list

REUTERS = U.S. Court Blocks Anti-Telemarketing List

WASHINGTON (Reuters) - A U.S. court in Oklahoma has blocked the national "do not call" list that would allow consumers to stop most unwanted telephone sales calls, the Direct Marketing Association said on Wednesday.
The U.S. District Court in Oklahoma City said the Federal Trade Commission overstepped its authority when it set up the popular anti-telemarketing measure, according to the DMA.

The FTC had signed up some 50 million phone numbers for the list, which was due to take effect on Oct. 1.


 
I whonder how they ruled that? Maybe congress has to pass arule to allow the FTC to do a list. But since the lst is voluntary I do not see it violiting any 1st admedments to free speech, which is what the telemarkters first said.

But this is juts ONE court, it will hopefully be overturned.

Yeah, PA has a list too & my calls went down dramaticly after signing up, though i still get a few a day.
 
more politics, more bureaucracy, more bs....This is getting ridiculous.

On the other hand, the FTC has a nice list to sell to the telemarketers.

Amen. I was literally looking forward to this on a daily basis. I get an insane amount of fvcking telemarketers. God-damn them ALL to hell.

Courts (and congress) have been owned by industry groups for a while now... RIAA, MPAA, now the DMA, I'm sure there are others I can't think of.
 
The courts pissed off congress:

Lawmakers criticized the court's decision, arguing that they had given the FTC the authority to implement the list.

"We are confident this ruling will be overturned and the nearly 50 million Americans who have signed up for the do-not-call list will remain free from unwanted telemarketing calls in the privacy of their own homes," Reps. Billy Tauzin and John Dingell said in a statement.
 
A couple of way to fight back.

1) When they call tell them to hold on one second. Just leave the phone off the hook and go about your daily business. Come back in about 5 minutes and check if they are still there. If they are, just tell them it'll be another minute.

2) Get them thinking you are really interested in buying whatever they are selling. Then just as they start to finallize everything, say you aren't interested and hang up.
