Op is forgetting one thing....physical evidence.

If you sexually assault a 4 year old girl - there is going to be physical evidence left behind, period.

I don't blame or find fault in the father at all - I have 4 kids, including a 4 year old boy - I'd like to think I'd do the same thing if that - god forbid - ever happened.

When police show up and want to know why you killed the person, you could just say you caught them sexually assaulting your child and acted out of rage. If the child is young enough (1-2) they won't be able to explain that nothing happened to them, they are too young to give reliable testimony.

Sure. But that would make you the kind of person who would murder someone in front of your 1-2 year old child. That person would likely already be in prison or have a criminal record and get sent to prison.

This sort of thing has been going on since before the dawn of history. Fear of the father is just part of the whole equation. This is my thought knowing nothing more than the thread title. I'll also throw in a Blakism: "One law for the lion and ox is oppression."

You understand that the process is investigate, charge, try right?

Not charging him doesn't mean they didn't investigate.
 
1) 4-year old girl was screaming, which drew father and other witnesses to area
2) Father saw perp on top of girl abusing her (her underwear was removed)
3) Father lost it, pummeled perp
4) Father called 911 and reported sexual abuse + having pummeled perp
5) Witnesses corroborate story
6) Townsfolk vouch for character of father as hard-working, honest and peaceful man

Any reasonable grand jury should decline to indict based on the evidence.

I think the father did not do enough, he should had made sure he is paralyzed so he can go to jail in that state and be free game.

I hope he does not get charged. The "victim" is obviously a sicko that deserves no part of society.

My first thought reading your ever so inappropriate comment was "fuck you". I don't know if you are trying to be funny or serious, it doesnt matter. Maybe I'm over reacting because this story strikes such a nerve with me. Children are innocent, children can't defend themselves. My first child will be here in November. If I EVER see someone touch a child in such a way so help me god I'll drag that sob around the corner and hit them with all the strength and anger I can't even imagine.

Reading this story I sit here with hands trembling and my heart pumping. Assuming the fathers story is accurate I feel no remorse for that piece of shit. This sort of justice for crimes against children was common place. He may not have intended to kill the man, but good job dad for protecting your family.
 
Whether charges are justified or not depends on the circumstances. Based on an article I read this morning it sounds like he only hit the guy a handful of times while pulling him off of the girl, and the death was truly accidental and unintentional.

If there's evidence that the dad held the dude down and beat on him for 10 minutes, he should absolutely be charged.
 
Hopefully there is some physical evidence to corroborate the father's account.

Something like scratch marks on the daughter's abdomen from the alleged victim forcibly removing the daughter's underwear and corresponding skin under the alleged victim's fingernails.

Hopefully that's all the alleged victim manage to inflict on the daughter and the father managed to stop any further assault.

Even if some physical evidence like that does not exist I doubt the grand jury will indict unless the autopsy of the alleged victim shows something like a sustained beating (the sheriff I believe said the father struck him "several" times which would be more than two but less than many, odds are that means that he struck him a limited number of times and that the force used will be considered justifiable)

Also the father was the one who called 911 and he did not believe that the alleged victim would die and was remorseful when he in fact did die.
