Something like this is really out of hand.. .

They should just beat that father senseless.

I feel for that poor kid, who is now ruined because of an idiot father.

Hopefully, they know this in prison. And you know what, I hope he gets raped and shanked, then dies slowly. Outside of that...this story is so sad. I couldn't fathom a life like this kids. Missing out on so much, and still. And from a malicious act. Why? thats all i can think is why?

Yes, he had intent, a prerequisite for a murder conviction.

But with some shouting "death penalty" I wanted to know how they would come down on a drunken pregnant mother. Do people think it's similar or very different?

Maybe. When you get bloodwork done while pregnant, I'd imagine that testing for diseases is common practice. Chances would be pretty good that you know you have AIDS/HIV, so if you choose to give birth to that child, wouldn't that be premeditated murder?

I dont think so because she did not (hopefully) get pregnant with the intent of infecting the child with HIV/AIDS.
In this case the father "injected BSJ with HIV, thinking that he would die right away and that he would not have to make child support payments." The child was perfectly healthy untill that point.

OMG, that is absolutely horrible. I agree with the judge, I hope this guy burns in hell for all eternity.

I remember this case from back when it was found out, and when it was tried.

As I recall, the case against the father was pretty sketchy. It boiled down to his motive and opportunity, all of whitch he denied, and they had no real evidence to back up.

The entire cased hinged on a supposed "prediction" Brian made to his GF that the baby would die young.

Go to Court TV and read about the case, Missouri v. Brian Stewart. This was by no means an open and shut case, and the conviction, IMHO, was based on the same type of reactions I see in this thread. In fact, if you look into the case, some of the mother's claims are pretty incredible to anyone who knows anything about this disease. Not only that, but the mother had many IV drug users and a known child molester staying at her house.

I saw everything the jury did, and I was left with more than reasonable doubt about the guy's guilt.

well at least the showed his picture in that report, and that prisoners have access to the interent now. cause in jail there is all kinds of sick crazy bastards there, but they all draw the line at hurting a kid. I hope they treat this guy like Dalhmer and kill him with broom sticks.
