I guess since he is serving life it really doesn't matter, but how the Hell was he only convicted of assault? It's clearly attempted murder (he didn't want to pay child support payments) plus a whole slew of other crimes. This guy ought to fry. Actually, maybe that's why they only tried him for the assualt, could they go after him again after the kid dies for murder?

Why can't he get the death penalty? It sounds like first degree murder to me...
Not that I don't think life imprisonment will be better this time, he deserves to live a long life while getting raped in prison.

Here's what I don't get about cases like this. They won't identify the child because he's a minor. But, the identify the mother and the father. Like anyone who graduated from Poirot 101 couldn't figure out the kid's name.

Hopefully, this guy's ass will get plenty of "injections" in prison.

He's not dead, you can't convict someone of murder if they haven't killed someone yet.

What about intended murder?

Should any woman who gives birth to a child with AIDS go to prison for life?

Food for thought.

Although I know how you ATOTers don't like to think. It's all about emotional, knee-jerk responses here.

that's what attempted murder is for. That would seem appropriate but practically it doesnt matter as he recieved life in prison.

Was the infection intentional? Should we punish her for not having an abortion?

This could indeed be charged as attempted murder, but I suppose the prosecutor wants to hold out for the first-degree murder charge that he can use if and when the child dies.

This is a truly horrendous case, and I hope the guy suffers plenty in prison.

Maybe. When you get bloodwork done while pregnant, I'd imagine that testing for diseases is common practice. Chances would be pretty good that you know you have AIDS/HIV, so if you choose to give birth to that child, wouldn't that be premeditated murder?
