Facebook can be sued if it tries to censor content, says French court

The High Court in Paris has set a legal precedent after ruling that the American social media giant Facebook can be taken to court in France.

surprise

It annoys me to be censored," he told BFM TV.

. . .

He is demanding €20,000 (£14,000) in compensation and to have his account reactivated

If I got €20,000 every time I was annoyed . . .

The court's decision comes as the French government is seeking ways of clamping down on hate speech on the internet

So they want websites to censor content . . .

During a hearing in January, Facebook had argued French justice was not competent to handle the case as the man had signed the social media group's terms that stipulate only American courts can handle disputes.

It also said he could not expect French consumers' rights as the service was free and he had opened an account on his own initiative.

But the court found Facebook's compulsory clause on jurisdiction, in which only a California court can handle disputes, to be "abusive".

how difficult is it for non-US residents to file suit in America?

The broader implications for being sued in every country you have a user is more troubling, especially when laws directly conflict (must not censor vs must censor for instance).

If instead of shutting down the account, Facebook dumped it into a country-only ghetto that could only be viewable to other accounts in France, I wonder what they would think of that.

I'm pretty sure that Facebook is a free service correct? With a Terms and Conditions when you sign up?

Go pound sand France.

The mods at facebook are total jackasses and immature. If the mods were at least in their 50's they would more than likely not censor so much. As far as I can tell the mods are in the mid 20's & very limited in their political education and much prefer playing on their xbox and playstation or playing world of warcraft.

I once tried to show this woman on facebook that what she was doing is wrong and then to truly do to her what she was doing to others.

She was there taking a big dump on any and all muslims. I am not muslim but consider myself christian -southern baptist
It was not that she was being offensive. But did not show any respect. So using her logic I then attacked her in the same manner she was attacking the muslims.

I called my form of attack as ART. Now that I am attacking her from the viewpoint of ART she had no right to get angry at me as now my form of attack is free speech.

She then flipped her lid and got angry at me then I mentioned she lacks class and respect.

Many saw my replies to her and agreed to me and their jaws dropped on how equally vile I was to her as she was to them. It was then Facebook banned me for more than 2 years to which I could really care less.

So I troll on facebook just bating those who refuse to respect other people. Sure I do not care if you hate them but like enemies often times they join at a fire camp to eat and smoke and respect each other then go back to their base camps to either cease fire or steam roll/over kill their enemy relentlessly.

Sometimes I love and hate the certain decor a website has. Sure you can fault them to a point for it but I kinda agree with how this anandtech controls things.

Facebook just needs to grow up.

inachu, all that and "Facebook just needs to grow up" as your final remark? Nonsense. I submit, people are the problem, not technology. When people grow up and realize the internet is not a playground, then we'll all be better off.

I've never had an account on Facebook because it's not for me. But to sit here and tell a website that caters to immature dimwits that it needs to grow up? No, once again, place the blame where the blame is due. People.

In response to the OP. So a country that wants to censor people is suing a website that censors people. blah, definition of wtfbbq

Was laughing and can somewhat agree to what you said.

Facebook sucks shit but this should be their right to censor whatever the hell users put on there.
