The vertical distance is less than the horizontal distance... In the second picture, the orange and light green are situated differently (due to the greater space left by the red piece's old space)
 
hmm, well there are 2 triangles there. i think that since one triangle is moved, even though the distance of the legs and hypotenuse stay the same, the components that now make up the "new" leg are shorter, and unable to complete the image
 
Just calculate the slope of the red and the green triangles and you'll see that their not the same 🙂

Edit: In other words, the shape on the top has its hypoteneuse "curving in" while the one on the bottom is "curving out", allowing for that "space".
