Hmmm... According to the EVGA warranty support page:
- ALL Defective products sent in for RMA replacement MUST INCLUDE A COPY OF THE ORIGINAL INVOICE / RECEIPT. (Products NOT including invoice/receipt will be returned to the customer at customer?s expense.)
If the card a new/sealed retail package and a receipt is included, then I would have to say that the warranty should be honored. There is no mention of where the product can or can't be purchased from.
How do you define "ORIGINAL INVOICE"? If Best Buy has an overstock of cards and resells them to OfficeMax, does that mean that the warranty is no longer valid because OfficeMax is not the "Original" purchaser? How about if a local Mom & Pop computer store buys a half dozen items to resell in their store? Does this mean the warranty is now null and void? Their wording leaves a lot open to interpretation.
- Lifetime Warranty is for all retail Graphics Card and Mainboard products ending in the part numbers A, AR, AX, BR*, BX*, DR, DX, FR, FX, SG, SL, or S2.
* [Replacement products are shipped out as ?BR or ?BX and will carry the same lifetime warranty that your original purchase had based on your registration.]
Again, as long as it's a new/sealed RETAIL package, then I don't see why EVGA would object. I define a "retail Graphics Card" as one in the full retail packaging. Otherwise, it's OEM or whitebox.
I think EVGA needs to spell out their warranty terms better if they want to specifically deny eBay/auction sales. But until they do, I really don't think they would want to be denying people on this basis as there is nothing concrete in their warranty terms that would prohibit it.
