I have an ati 9800 pro that I flashed to an xt. am i a thief for doing so?

what kind of distinction can you make between flashing to a higher grade model and overclocking? it is up to the manufacturers to include preventive measures if they find this significant to their revenue and whatnot. i mean would 'upgrading' regular pepsi to lemon twist by adding lemon juice in it be considered unethical?
as long as you dont request RMA due to failed flashing, i dont see any moral issues involed here.
 
The 3rd (WAS at one point the 1st) highest score on 3dmark05 is on a x800 pro flashed to XT PE. Thats proof that flashing is teh winz.

not quite the same thing. this is more like better tuning your engine that you bought and paid for. your example is more like buying a cheeseburger, asking for a cup for water, and then filling it with coke
 
Yeah, I'd say its ok. Once you've purchased your product, youcan do what you want with it. It's not like when you bought it, you signed something that says you will not screw around with it.

Physical property is not the same as intellectual property. I'd hope I don't have to explain that.

Again, I'm assuming what EyeMWing said is true.

If it is, and the EULA doesn't make note about installing it on cards other than the one it was intended for, then my point is moot. I've never paid attention to firmware updates because my stuff works OOTB
