I love drinking and I love driving. I am a big anti-DUI/DWI law when it comes to what MADD/SADD have created.

However, sir...you have become my poster boy on why those laws came to be.

Like how it gets presented to you by these groups:

Let's start your evening...at the end of a 37 hour stretch with no sleep, exhausted...you decide to drink 3 beers in the next three hours that came from the 6 pack that you bought on the way home (which is now miraculously empty). Then to top that off decided to go drink some more outside of your home.

Did you other 'self-inflicted' auto accident go down the same way?

Driving While Stupid. If you're so tired you cant park a car, you were probably driving just as bad as the idiot that drives drunk.

If you know you are having trouble staying awake, please get off the road. Accidents don't just happen to drunk drivers they happen to tired drivers, to distracted drivers, to completely innocent drivers who get broadsided by someone too tired see the red light at the intersection in time.

Don't fix the car to remind you not to DWS again.

Saying you were close to DUI is too close IMO. If he couldn't park without doing that, he shouldn't have been driving.

You may not blow a .08, but if the guy got 3 hours of sleep in two days and drank to the point where he can't park his car, he probably would have failed the field test...

on blood alcohol level I agree. However, in this case actions decide.

I am so anti-dui. I was stopped with a receipt from a comedy club...I was there four hours and had four drinks (dom. beer), got stopped on the way home and despite doing my roadside fine (in the middle of a non-divided two lane highway with cars still coming on both sides while the cops stood off to the side of the road), then being asked to say the alphabet backward (which I know and did three times, written down correctly on the papers)...I get arrested. At the station I blow a 0.168...at the time I was weighing 190lbs.

Reason for the large difference was due to having a large open cut to my bottom lip caused by my teeth getting nearly pushed through it.

I just paid it out about $5000 and a few nights in meetings and about 3 months someone had to drive me. If I decided to fight it (which is smart if you plan on ever getting a second one), it would cost about $10000 min, more like $15k (unless you get lucky with a cheap ticket lawyer and have a procedural technicalicity in your arrest....they usually can't beat the breath test here)....but the kicker would be I would not be able to drive until the end of the case, takes about 6-12months to get a court date here. Then you have the court date, plus usually a second one (this one usually within 3-6 months)...

The law sucks and people think that a few drinks now equal road menace. Facts are most people suck at driving and were probably destined for their accidents....also facts are in the whole scheme of traffic fatalities DUI/DWI is not the main reason, esp for the sheer number of 'drunk' people driving every Thursday - Saturday night on the roads.

However, who is going to argue with a mother and a picture of her mangled baby...a la Jacquie and the like. Unfortunate yes, but so is the child that gets a hand lopped off sticking it in a fan belt....do we outlaw fan belts next?

I have no idea why you folks would infer that I meant he was fine to drive.

My ONLY objection was to the claim he was DUI.

BTW, Savij NEVER, and I mean NEVER agree to a field test. Say nothing, ask if you're under arrest, and if so, demand a blood test. Agree to nothing else and say nothing else.

I didn't say he was DUI. I simply said if he does, I hope he gets taken to jail. Didn't mean to imply it this time.

I agree with this. Make sure you let the officer know you have are not denying his investigation. You are agreeing to a blood test. Looking back I'd make up I have a fear of things being put in my mouth or easier I believe AIDS is spread by breathalyzers. :)

The bad news on this is you will ride cuffed to the blood test, they will tow your car (DUI Tow is a special high fee, about $200 for just the hook up and 4x any mileage rates). You will not get that money back even if innocent. Also you will need a ride from whereever the blood test was given, assuming you pass. If they can't provide results instantly you will be put in 'jail' until they come back. Good news is I have yet to hear a blood test be off, unfortunately it's easy to read over .08 and not be impaired at all.

Driving drowsy is just as bad as driving drunk. Some studies have shown it to be worse (regarding reaction time and alertness). Having said that, 3 beers in 3 hours is not drunk.

He was under the influence. When you are totally fatigued, you are a "cheap date", face the facts. Can any of you drinkers answer that differently? Alcohol effect is very dependant on your condition. Just because he may have only blown a .09, by his admission you could have pushed him over with a feather.

To the OP: Don't fix your car. Wear that damage like a badge, and let it remind you to use your head. Put the money you'd spend in a CD or savings account, and let that remind you as well.
Driving into oncoming traffic asleep is really no different than doing it drunk. Both involve some really flawed judgement IMO.

3 beers in 3 hours is no where near a .09. More like .006 for a 150lb male. It wont even register on most test kits.

roadside I believe...however, if you can absolutely pass the blood test, this is where almost any lawyer can still save you. Do not INSIST on the blood test and fail it. If you know you have had a few too many, be polite, try to not piss the occifer off.

In case anyone doesn't know yet, Fieldside Sobriety Tests make non-drunk people look drunk. There was a tape I saw by my lawyer before I decided to just pay out....about 20-30 people all doing roadsides. At the end they show the BAL of each...I did poorly...they all seemed drunk.

For those that don't understand DUI/DWI laws, there is no due process. As a matter of fact you can totally pass all tests and still have to spend a mandatory 8 hours (really over 12) under observation in jail.
