Pretty much. I don't think the lawsuit is justified, but my opinion rarely matches California's.

The fact that people keep bringing up that eHarmony is a private business is irrelevant. Private businesses that open themselves to the public ("places of public accommodation" like retail stores) usually are not allowed to discriminate based on membership in a protected class. It sounds like sexual orientation is a protected class in California. The fact that might protect eHarmony is that they are selective in who they allow to join - they reject straight people too. Much like a private golf course can exclude blacks if they are exclusive in their membership, that may allow eHarmony to discriminate against homosexuals. But this is California...
