Seeing as the Japanese are whaling in that area Illegally they have no leg to stand on IMHO. Sea Shepherd are the only people out there willing to call out the Japanese on their activities.

Also, the act of one party or group doing something "illegal" is not grounds to allow someone else to do an illegal thing in return.
The Japanese are well within their rights to detain the guy and take him back and put him on trial. He ILLEGALLY boarded another vessel. Now he has to pay the consiquences. To bad this isn't pre WW2 Japan. They would have taken care of the problem already.
