Ebay related,can the seller keep the item and money?

I had to return an item because it doesn't work with my system,seller sent shipping label via ebay's system,item return but now the seller filed a case against me because he thinks " I don t think it s right to basically spend money just for someone to try something out." which im in shock he wants the item and the money.Has anyone gone through that because?

Ebay / paypal sides with the buyer 99% of the time so just file a dispute with them and they will get your money back.

Granted if it was your fault as you should had known if it would had worked with your system that's kinda on you and at the very least you should have to pay shipping provided it was not new in box.
 
What did his selling page say about returns?

I agree with Newbian...sounds like this is on you, not the seller, so you should be on the hook for shipping costs both ways.
 
Unless the listing was wrong this is on you.

You should expect at most a refund minus shipping costs, and a restocking fee would also be reasonable.

Just file a dispute, you'll get your money back.

I had a problem earlier this year, seller had a dozen reasons to not reimburse, PayPal made him reimburse me, I just ignored him.
 
There are some big businesses that sell through eBay and they have generous return policies. This does not sound like one of those cases. This sounds like an individual, and so if the item was not broken and the description was accurate, you should keep the item.
 
You need to pay the return shipping charges, and the seller has no obligation to refund you your initial shipping cost either, since the return was entirely your own issue. That said, they can't accept the return, and then not give you a refund. The correct course of action for the seller would have been to list the item with no returns accepted, then refuse your return, citing that they only accept returns for items that arrive not as described. In those situations, shipping is covered by the seller.

I would suggest you explain the above to them, and tell them to take the shipping charges out of your refund; eBay has a provision for this, but I believe for it to be done automatically, they had to choose the correct option when they sent you the label.

Still, they are being a dick, but you might as well be the bigger person and follow the rules.
 
I would contact Ebay as soon as possible about it, normally the seller loses when it comes to disputes well atleast 90% of the time from what i've read and also experienced from taking payments on PayPal.
 
Ebay and Paypal will side with the buyer no matter what, so just open a case about it.

They accepted the return, then tried to screw the buyer. Why are you sympathizing with them? All they had to do was list the item as no returns and refuse the buyers request.

Right or wrong they will side with the buyer and I've been on the other side of it as well. The buyer needs to do the homework before buying it, but the seller shouldn't have authorized the return and when he gets it then decides to be a jerk about it being returned.

The problem with that is it does not work if you are selling through ebay as it violates their tos.
 
You'll win but the seller is probably pissed that he has to pay Ebay and Paypal fees and give your money back because you wanted to send a working item back.

Ebay sucks for sellers. I sold a text book where I blocked buyers from out of the country and would only ship to the US. I even wrote it in the description. So I get a buyer who wants me to ship it South America (don't forget that I had free shipping to the US). Since the account was a US account, it let them buy it. I refused to ship overseas since it was not in my terms. I had to file a cancellation that the buyer has to approve or I lose my fees.

I ended up losing $20 in Ebay fees over that one.

I also sold a lens on Ebay where a fake buyer purchased it and it took weeks to get Ebay to cancel the bid. They argued with me that I should just send it since the account might be real!

As the first links says, as the seller:

"You're responsible for final value fees whether you complete a transaction with a buyer or not. In a few circumstances, however, you may be eligible for a final value fee credit."

I have sold quite a few items where the buyers just never paid. I opened a dispute after waiting 7-10 days for payment. My seller fees we credited after a short wait. Within 7 days I think, if the buyer doesn't respond, and less time if he does.

Important thing is to do it through the eBay system and within the time frame they list.
 
Yeah, pretty much the only thing I like about PayPal. They do actually refund the fees, when you refund.
