Ebay problem, unsure of my responsability

I had bought some collector's items several years ago, special edition DVD's, there were only 15,000 made, each one was numbered. I figured I'd get them as an investment, maybe make a few bucks on Ebay. Well, it's 3 years later, and I've started selling them on Ebay, and the 4th one I sold has a problem. The guy who won the auction opened it (they are all factory sealed) and tried to play the DVD, but he says it won't play on his DVD player. He tried to play it on several other DVD players and had the same problem.

I'm wondering where my responsability is here. It's not like I sold him something used that didn't work, this was in a sealed container, so if there was a problem, there was no way for me to know it. Since I purchased these items over 3 years ago, I can't go back to Amazon for a refund. I'm thinking the guy who has it now might be able to contact whoever manufactured the DVD (Anchor Bay) for a replacement. Any thoughts?
 
Assuming you are ahead of the game (money wise) I would give him a refund for the purchase. People really appreciate good business and giving a refund would fall under that category I'd say. It would be kinda like selling a nice wine -never openned- and the person receiving it and it turns out to be water.

After the refund have him send the DVD back then you can contact the manufacturer.
 
It's not your problem -- based on experience, it's a manufacturer problem. He should contact the manuf/publisher directly. I had the same problem with a Space Camp DVD and I was told to contact the DVD producer, Anchor Bay. I mailed them my non-working disc, and they mailed me one that played in my player.

 
I think it depends a lot on what exactly you committed to in your auction. If you garaunteed No DOA or garaunteed it to be working, you should accept to take it back. Assuming that you had no garauntees and just said "New", then it is really up to you on whether you want negative feedback or not.
 
Chances a dvd is messed up (retail) and wont play 1:1000,000,000,000
Chances he got it from you, copied it, says it doesnt work, and wants his money back 1:2

Ask that he returns it to you. Postage for the time being paid by him. If he refuses he copied it and is trying to scam you. If he does send it back check it out carefully. Look fo rself inflicted damage. If none is found offer him something else in its place and still if not cut your losses and return the money. If it is trully messed up ou will only look good in his eyes and less of a hassle. If you dont and wish to fight it till the end then he could cause you trouble.
I know that if the disk trully is messed up just to save face and hassel with PP ebay and other factors refund the money and try to return the disk yourself and re sell it.
If he gives you hell about returning it I would be very woried that it may work and he copied it and just askign for his money back to scam you.

Well, he already gave me a positive feedback, I guess that was before he opened it. I just don't want to feel like I ripped someone off. The auction said it was new, mint condition (which it was), but the only way to know if the DVD works or not is to open the container, and then its value goes down because it is used instead of new.

I don't know why he would want to pay $45 to copy a DVD when he could just get a regular one for $8, doesn't seem worth it to me. Plus if he sent it back to me and it worked on MY DVD player, I would refuse to send it back to him. Ditto if it was all scratched up.

Hope that guy isn't trying to scam you! That would really suck, and it certainly doesn't make any sense. What's the DVD title anyway? 🙂

lol, wow, they are quick, I just received an email with the address to ship it back to. Looks like problem solved, I can just forward the info to the buyer, and he can get a replacement.

The DVD was Heathers, comes in a tin with a bunch of stuff (notebook, ruler, etc). I had 13 of them, sold 4 so far, I'll probably wait a while to sell the rest of them.
 
Tell him it's not your problem, since you sold the item as brand new factory seal, it's the manufacturer's responsibility.

Yah, they're not too bad. But at the same time, it makes you wonder how many defective DVDs they get every month and replace 😉

If it was new & unopened there isn't much you can do other than join with him to go after AnchorBay for a replacement. That is if they actually have more of them around, which is unlikely.
