Ebay just banned me! What the hell?!

They probably just think that by stating you can "play backups on that psx" it's a modded one, and you're just leaving that part up to the bidder to guess. My thinking is that this is a special psx that didn't need modded to use them, a japanese one perhaps?

A legal "backup" (I have several) is a copy of a program you already own. I have some for the pc, as well as my DC. Example, I bought resident evil: Code veronica for the DC, and being an oaf, pulled the DC off the shelf while playing. The CD got a massive scratch on it and it wouldn't boot. I hopped on IRC, found the image, and burnt a replacement. I already owned the original, so a copy was legal. The same applies for software. As long as you own (and still have in your possession) the original copy of a piece of software, it is legal to make a backup.

This same law makes sharing mp3's legal, IIRC. It states you are legally allowed to make a copy of a record/cd/etc that you own, and give it away for free. The minute you charge for it, it is illegal. The problem with napster, is that many people were making a profit selling cd's of music. One computer show I worked, a guy had several pages of mp3's he had there on his pc. For a price, you could fill a CD, have it burnt while you browsed the show, and pick it up later. This was before they were heavily targeting napster, as I'm sure the cop walking around would have objected now.

dude you are like 13 or something...people that young shouldn't be on ebay. No I'm not joking around...dead serious. The age limit should be 18 IMO.

I'm pretty sure its the same with with PSX/other new games, but I know on ALL of the old super nintendo/NES games it stated clearly in the manual that you are NOT permitted to make backup copies. Just because you own something does NOT mean that you have the right to back it up. I'm not sure if this is in Playstation manuals as well, I'll go check it out, but I clearly remember that being in older games.

They banned you because originally you said MODDED, and then you just reworded it to claim &quot;backup&quot; even though you had previously said modded...

Just FYI to everyone-

The first two production runs of the SCPH-1001 Playstations had the ability to play backups using the 'swap trick'. You had to boot the Playstation with a legitimate game or the demo CD, open up the PS after a specific CD read speed change, and then drop in the backup. You can tell which Playstations can do this by checking the manufacture date and model number on the bottom- it must be an SCPH-1001, and I think they were all manufactured by/before May 1995.

I've seen it done many times, so I know it works. Some third party vendors even sold 'swap trick' kits so that you could hold the lid of the PS open, and have it think it was closed, just so you could swap the CD's out more easily. I own an SCPH-1001 3rd gen, and an SCPH-5501, so this doesn't work for me. Mod-chips are the best way to go. :D

Just a heads up to let you guys know that it is possible to have a PS that will play backups with no modifications.. but they're pretty rare these days.

I suppose ebay's system took that to mean that there would be some kind of surcharge on something and I had my auction ended.

infringement of copyright law. You have the legal right to make a backup of
a game you own and play it on your system. Please consider this before you
suspend my account.


Jeez, I hope they don't suspend me. I can't live without ebay. :p

See, the thing is that Ebay has a zero-tolerance policy for ANY grey-market/potential piracy issues. For example you cannot sell ANY import games, or anything related to &quot;backups&quot;

By stating that your system can play &quot;backups&quot; you are inferring that somehow the inherent copy protection on the PSX has been defeated. Whether or not you used a mod chip is irrelevant; the point is that Ebay has to protect their own ass from overzealous copyright lawyers, so anything even remotely related to the fact must be eliminated.

Don't argue with them, just take it as a lesson learned.

Yea, that's what I was selling. An original 1st generation PS that had the ability to play backups with no modifications.

Once again, there is no LAW stating that BACKUPS are ILLEGAL. They are fully legal as long as you don't abuse them.

I wonder if they're taking the buy.com customer support track, and just having a robot go over the listings one by one looking for keywords. Someone should try that, post a couple CDR's and list that they're &quot;great for making backups of your hard drive&quot; and see if your listing gets yanked. They're obviously not checking these on on a case by case basis, because KNTX's got pulled and it sounds like he wasn't breaking a rule.

If you ask me, that robot approach, while it saves money, is a huge PITA. Makes getting help very difficult. I had a problem with my shipping charges for my buy.com order, filled out the form on their website, and got a canned response back explaining where to find shipping costs on their website (which didn't help me at all)
