Ebay Issue - Am I in the wrong here?

Ok, so last thrudsay (3/20) I bid on and won a PS3 for $320 (+$20 shipped) which seemed like a decent deal considering it will come in the original box, with spiderman on blu-ray, and the receipt, blah blah blah.

Anyway, I sent payment the following morning (3/21) via PayPal (non-cc funds). I have yet to hear ANYTHING from the seller (Who had over 600 feedbacks with 1 negative).

I have sent 3 messages via Ebay. The first two on Monday and Wednesday and finally one this morning. In my first two messages I nicely asked if and when the item had shipped and if there was a tracking number. In the final message (this morning) I told the seller if I haven't heard anything from him by tomorrow morning that I will be opening a PayPal dispute.

I always feel like an ass making threats, but the purchase is big enough that I want to make sure all is in order. So I just wanted to see what the other folks on Anandtech thought. Am I being rude making "threats" at this point, or am I justified.

The other thing is, I am sure if it does go south PayPal will tell me to go fly a kite. I have gotten ripped off once before on Ebay and PayPal basically said "sorry" and that was it. Fortunately my credit card company stepped up to the plate.

I would do the same thing you have done... a week without hearing from them, especially for something like that, is way too long. I mean, you don't list something then go on vacation. There is always a chance something happened, but you gotta look out for you, and your money.

If it turns out he had a family emergency, death in the family, etc then I will apologize. I didn't curse at him or anything. I simply explained it has been a week with no contact and this is what I will be doing.

90% of auctions i see say the WINNER must contact the seller/pay within 3 days...a week without hearing from the seller is unacceptable.

You can't get any better than what ya did. With that kind of feedback, I'd be pretty confident the deal will be good.

DigitalHippie, I agree that with that kind of feedback everything will work out. However, I like to cover my butt.

You did the right thing, glad you got the goods. Some people just don't like to communicate and function like robots on ebay. You send them money, they send you product, no communication what so ever.

It's still the seller's fault for not sending you a message and for not answering your emails for a week.

Nope, you did just fine. I would leave him a positive, but a poor rating under the "Communications" area....

One week is a very typical turn-around time from sending payment to receiving your item. Some great sellers are a few days less, some lazy sellers are a few days more.

I generally don't start sending ultimatums until the 14 day mark. PayPal gives you plenty more time to file a dispute. In fact, I don't think PayPal even takes item-not-received disputes seriously at the 7 day mark.

^ true, but dead silence from the seller for a week on a $300+ item is still not good communication. Not worth a negative, but worth noting in the new detailed feedback.

Then you have WAY more patience than I do. I find it absolutely UNACCEPTABLE for someone to take more than a few days to ship something to me from the moment they received my money.

I do understand if some extreme emergencies came up but even during those emergencies, I find it really hard to believe the seller did not have time to shoot a simple quick email to me informing me of the situation.

I am cool if it takes 2 weeks to get here, but tell me that. It was the lack of communication that bugged me.
